They protect the archaeological landscape of Huaytará against invasions

The Ministry of Culture has determined the provisional protection of the archaeological landscape of Huaytará sector 2, located in the district and province of Huaytará, department of Huancavelica, due to the verified impact of invasions and progressive settlements. The decision was adopted through Directorial Resolution No. 000246-2026-DGPA-VMPCIC/MC, signed in San Borja on September 2, 2026, and published in the Official Gazette El Peruano (Legal Norms, Year XLIII, No. 19505) on Monday, September 7, 2026, pages 8 and 9.

The measure was issued by the General Directorate of Immovable Archaeological Heritage (DGPA), whose office is led by Janie Marile Gómez Guerrero, exercising the authority delegated by the Vice-Ministerial Office of Cultural Heritage and Cultural Industries through Vice-Ministerial Resolution No. 000318-2025-VMPCIC-MC. The technical support comes from Inspection Report No. 003-JSM/SDPCICI/DDC HVCA/MC, dated July 7, 2026, prepared by the Decentralized Directorate of Culture of Huancavelica.

A threatened pre-Hispanic heritage

The technical inspection determined that the main factor affecting the archaeological landscape is of human origin. The installation of old data antennas was identified and, more recently, the construction of rustic dwellings that would be part of settlement processes or progressive invasion of the archaeological area, which would imply greater future impacts.

Added to this are natural factors that deteriorate the structures:

  • Growth of vegetation, grasses, and shrubs over the main structures.
  • Collapse of walls due to natural causes.
  • Weathering and wear of the construction elements.

Scope and protection measures

Directorial Resolution No. 000246-2026-DGPA-VMPCIC/MC establishes provisional protection for a period of two years, which may be extended. If a direct impact on the collective rights of indigenous or native peoples is identified, the maximum period for the definitive declaration and delimitation of the asset is extended to three years, extendable for the corresponding period upon prior justification.

As preventive measures, the stoppage and cessation of the impact within the delimited polygon, the signage of the area, and communication to local authorities are ordered. The protected area is defined according to the Perimetric Plan PPROV-103-MC_DGPA-DSFL-2026 WGS84, which is annexed to the resolution along with the technical and legal reports that support it.

The resolution orders the notification of the District Municipality of Huaytará so that it may proceed according to its competencies, in accordance with Article 82 of Law No. 27972, Organic Law of Municipalities, and to the administered parties indicated in Article 104 of Supreme Decree No. 011-2006-ED.

Regulatory framework

Protection is based on Article 21 of the Political Constitution of Peru, which protects assets presumed to be part of the Cultural Heritage of the Nation, and on Law No. 28296, General Law of the Cultural Heritage of the Nation and its regulations. The special provisional protection regime provided for in Chapter XIII of the regulations, incorporated by Supreme Decree No. 007-2017-MC, is applied, which allows for action in the event of a verified impact or a probable risk of impact to assets that have not yet been declared or delimited.

The measure takes effect from its publication in the Official Gazette El Peruano, and its dissemination is also carried out on the Institutional Portal of the Ministry of Culture.

The provisional protection of Huaytará sector 2 constitutes a key step in halting the occupation and deterioration of a pre-Hispanic archaeological landscape in the highlands of Huancavelica. With this resolution, the State initiates the process for the definitive declaration and delimitation of the asset, guaranteeing its conservation against urban pressure and natural agents that threaten its integrity.
