Flemish social protection: affiliation via partial payment of the premium

The Flemish Government adopted an order on July 17, 2026, amending the implementation of the 2018 decree on Flemish social protection, in order to specify the conditions for the affiliation of insured persons via partial payment of the premium. The text, referenced C − 2026/006310, was published in the Belgian Official Gazette No. 192 of August 27, 2026, page 46979.

The order amends the order of the Flemish Government of November 30, 2018, implementing the decree of May 18, 2018, regarding Flemish social protection. It is based on articles 42, § 4, and 45, § 1, paragraph 2, of said decree. The initiative is led by the Flemish Minister for Welfare, Poverty Reduction, Culture, and Equal Opportunities, C. GENNEZ.

A targeted amendment to Article 63

Article 1 inserts, into Article 63 of the 2018 implementing order, the phrase “for the first time at least 8 euros of” between the word “pays” and the word “the”. This specification sets the minimum threshold for partial payment of the premium from which the insured person’s affiliation with Flemish social protection is recognized.

Procedure and opinions gathered

The preliminary formalities were completed within the deadlines:

• Finance Inspectorate: opinion rendered on June 2, 2026;
• Council of State: request for an opinion within thirty days submitted on July 3, 2026, pursuant to Article 84, § 1, paragraph 1, 2°, of the coordinated laws on the Council of State;
• the Council of State decided, on July 8, 2026, not to render an opinion, pursuant to Article 84, § 5, of the same laws.

Entry into force and execution

Article 2 provides that the order enters into force on October 1, 2026. Article 3 charges the Flemish minister responsible for social protection with the execution of the text. The order was signed in Brussels on July 17, 2026, by the Minister-President of the Flemish Government, M. DIEPENDAELE, and by the Flemish Minister for Welfare, Poverty Reduction, Culture, and Equal Opportunities, C. GENNEZ.

For those insured under Flemish social protection, this amendment clarifies the conditions for affiliation in the event of partial payment of the premium, by setting a minimum threshold of 8 euros for the first time. It thus secures the affiliation regime for the persons concerned as of October 1, 2026.
