Porzuna regulates civil marriages and sets a fee of 20 and 50 euros

The Porzuna City Council has definitively approved the Municipal Ordinance Regulating the Performance of Civil Marriages and the Regulation of Fees for the Provision of the Service, which establishes a fee of 20 euros for contracting parties registered in the municipality and 50 euros for those who are not. The regulation, adopted in an ordinary session of the Plenary on July 8, 2026, is published in the Official Gazette of the Province of Ciudad Real on September 2, 2026 (announcement number 2812).

The file was subject to public consultation for 30 days via an announcement published in BOP no. 130 on July 10, 2026, and on the notice board of the municipal electronic headquarters. Since no claims or allegations were filed, and in application of article 49.b) of Law 7/1985, of April 2, Regulating the Bases of Local Government, the provisional agreement is understood to be definitively adopted. The ordinance was signed by the mayor, Carlos Jesús Villajos Sanz, on August 31, 2026.

Purpose and regulatory framework

The ordinance unifies the regulation of the celebration of civil marriages and the fees for the provision of the service into a single rule, responding to social needs that are “increasingly demanded by our citizens.” It is issued in accordance with Law 35/1994, of December 23, amending the Civil Code, and the instructions of January 26, 1995, and January 10, 2013, from the General Directorate of Registries and Notaries regarding the celebration of civil marriages before the Mayor or delegated Councilor.

On the fiscal level, the levy is based on Royal Legislative Decree 2/2004, which approves the Recast Text of the Local Treasuries Law. The fee will be required under a self-assessment regime, and payment must be made prior to the celebration, presenting the proof of payment along with the file documentation.

Location, dates, and processing

The celebration will generally take place in the plenary hall of the Porzuna City Council, although it may be authorized in other municipal offices or premises that meet adequate conditions of decorum and functionality. Marriages will be celebrated from Monday to Friday, excluding holidays, although the Mayor’s Office may exclude days for scheduling reasons.

• Exceptionally, when at least one contracting party is registered in Porzuna and cannot adapt to ordinary days for work reasons, they may marry on a weekend or holiday if the schedule permits.
• Date commitments will not be accepted for a period exceeding twelve months from the receipt of each request.
• Celebrations shall be granted by the Mayor’s Office, which may delegate to a Councilor for specific dates, periods, or shifts.
• Throwing rice, confetti, petals, or other elements inside the room is prohibited, and any special decoration shall be the responsibility of the interested parties.

Fees and Deductions

The ordinance establishes two fees based on the registration of the contracting parties:

• 20 euros when at least one of the contracting parties is registered in Porzuna.
• 50 euros when neither of the contracting parties is registered in the municipality.

When there are social or charitable reasons that advise it, the Mayor, upon request from the taxpayers and following a proposal from the City Council’s Social Services, may grant a full deduction of the tax fee. The fee accrues at the time the request for the specification of date and time is submitted, and no refund shall be issued when the non-provision of the service is attributable to the taxpayer.

Entry into Force and Appeals

The ordinance shall enter into force on the day following its publication in the Official Gazette of the Province of Ciudad Real and shall remain in effect until its express modification or repeal by the City Council Plenary. An administrative appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Castilla-La Mancha within two months of publication, in accordance with Article 46 of Law 29/1998, of July 13.

The new regulation provides legal certainty to couples wishing to marry in Porzuna and provides the municipality with a clear framework of rates and conditions, with differentiated and more favorable treatment for registered residents and a path for exemption for those who prove social or charitable circumstances.
