Correcting the error in Portugalete's PGOU, compatible use increased to 15%

The Portugalete City Council has corrected a material error in the urban planning regulations of the General Urban Development Plan (PGOU), regarding the SUZ-1R Vicios sector: the maximum buildability for compatible uses has been increased from 5% to 15%. The agreement was published in issue number 166 of the Official Gazette of Bizkaia on September 1, 2026, with the official reference BOB-2026a166-(II-4613).
Correction of the error
The City Council, in its ordinary meeting held on July 30, 2026, approved the correction of an error appearing in the Urban Planning Norms sheet of the SUZ-1R Vicios sector. The published text stated: «Como máximo podrá destinarse a usos compatibles el 5% de la edificabilidad urbanística del sector». After the correction, a percentage of 15% has been established, which is exactly what the City Council had approved throughout the PGOU process.
The correction was carried out under the protection of article 109.2 of Law 39/2015, that is, according to the Law of Common Administrative Procedure. The agreement explicitly states that the correction is limited to rectifying a material error, without altering the substantive content of the planning.

Procedure and signature
The agreement first involved the City Council renewing the urgent procedure, without a report from the Urban Information Committee, to correct the error as quickly as possible and to ensure greater legal certainty. Subsequently, it was decided to correct the error and publish the agreement in the Official Gazette of Bizkaia, also correcting the published document.
The agreement was signed by Mayor M.ª José Blanco Gavieiro in Portugalete, on August 24, 2026. This correction provides clarity to the urban planning conditions of the sector and establishes a solid legal basis for future development and promotion projects.
