Ports grants Alcúdia the concession to build the Bonaire WWTP
Por FactBox Admin

The Board of Directors of Ports de les Illes Balears agreed, in the session of September 24, 2026, to grant the Alcúdia City Council the administrative concession for the construction of a wastewater pumping station (EBAR) in the Bonaire port area, in the municipality of Alcúdia. The agreement, electronically signed on September 25 by Vice President Antonio Mercant Morato, is published in the Official Gazette of the Balearic Islands (BOIB) no. 122, of September 29, 2026, under announcement number 9721. The installation is planned within the Project for comprehensive sanitation provision to the urban sectors of the Mal Pas and Bonaire residential areas.
The concession is conditional upon the approval of the Project for the surface concession for parking and the new Cocodrilo EBAR, also in the municipality of Alcúdia. The grant is made under a direct award regime, as the beneficiary has the status of a Public Administration, and is framed within inter-administrative collaboration for a project declared of general interest for the port area.
A file opened in January 2024
The procedure stems from the proposal that the Alcúdia City Council presented to Ports de les Illes Balears on January 12, 2024, given the non-existence of other suitable public spaces in the urban center to locate the EBAR. The technical services of PortsIB reported on July 8 and 26, 2024, that the outdoor parking space of the Marina Bonaire Sport Port concession was the location most compatible with port operations.
The main facts of the processing are as follows:
- February 18, 2025, and February 16, 2026: the City Council requests the concession to occupy 532.60 m² and install the EBAR, with a report from the municipal engineer Jaume Domingo Ribas regarding the strictly necessary space.
- February 20, 2025: the ITOP head of Section VII (Indirect Management) reports favorably, while fixing the necessary surface area at 145.67 m².
- June 11, 2025: report from the technician of the Indirect Management Area on the project’s compliance with Law 10/2005 and Decree 11/2011.
- July 26, 2025: publication in BOIB no. 97 of the public information announcement of the project, for a period of twenty business days.
- July 14, 2026: notification of the resolution approving the offer of conditions, with ten business days to accept it or file an appeal.
- September 22, 2026: entry into the PortsIB electronic registry of the mayoral resolution of September 15, 2026, accepting the conditions.
Exempt fee, 50 years and 137.46 square meters
The particular conditions of the concession establish the following parameters:
- Object: installation and operation of the WWTP (Waste Water Treatment Plant).
- Surface area: 137.46 m², according to the attached plan.
- Fee: exempt, as it concerns a Public Administration carrying out an activity of general interest.
- Term: 50 years, the maximum permitted by port regulations.
- Final guarantee: 5% of the works budget.
- Civil liability insurance: minimum amount of 1,000,000 euros, including risk for accidental and environmental pollution, and Ports de les Illes Balears as an additional insured party.
- Prior obligations: environmental report with a monitoring program, appointment of technicians for environmental monitoring and for the direction of works and operation, and means for the prevention and fight against accidental pollution.
The works must be executed in accordance with the projects for Cocodrilo and the comprehensive sanitation of Mal Pas and Bonaire, and the execution period shall be that provided for in the corresponding administrative contract.
The recovery of land at Marina Bonaire
The Governing Council agreed on March 6, 2026, to declare the public utility of the project regarding the installation of the WWTP and the urgent occupation of the affected lands, which were part of the administrative concession of the Port of Marina Bonaire. The concessionaire MARINA BONAIRE, S.L. expressed its acceptance of the recovery of 145.67 m² on March 16, 2026, and on April 10, 2026, the reversion act was formalized, with a final affected surface area of 137.46 m².
The legal framework of the agreement includes Law 10/2005, on the ports of the Balearic Islands, and Decree 11/2011, which regulate the procedure; Law 33/2003, which allows direct award in favor of a Public Administration; Law 11/1998, which exempts the occupation fee; and the general specifications approved by the Order of the Minister of Territory, Energy and Mobility of July 1, 2018. Against the agreement, which exhausts the administrative route, an optional appeal for reversal may be filed within one month or a contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Palma within two months.
The publication closes a file of more than two and a half years and unlocks a key infrastructure for the sanitation of Mal Pas and Bonaire, two coastal urbanizations of Alcúdia. The work must coexist with the activity of the marina and comply with strict environmental requirements, with technical monitoring and specific insurance for pollution.
