Judiciary excludes two experts for lacking a validated email

The Executive Directorate of the Judiciary of Costa Rica excluded two professionals from the list of Auxiliaries of the Administration of Justice for not having a duly validated email address to receive notifications. The decision was formalized in resolutions 614-2026 and 615-2026, both issued on July 16, 2026, and published in La Gaceta No. 166 on Thursday, September 3, 2026, in the Notifications section.

Those affected are Jorge Arturo Quesada Pacheco, registered in the Linguistics category, and Luis Alberto Aguilar Rodríguez, registered in the categories of Agronomist Engineer and Private Brokerage and Real Estate Valuation. Both failed to comply with the requirement of Article 11, paragraph 2, of the Regulation governing the selection, designation, and practice of interpreters, translators, experts, executors, and procedural curators in the Judiciary.

Regulatory Framework

The applied regulation was approved by the Plenary Court in session No. 37-2023 on August 21, 2023, and published in the Judicial Bulletin No. 181 on October 3, 2023, via Circular 227-2023 of the General Secretariat of the Court. The norm requires every expert to designate an email address accredited before the Information Technology Directorate, pursuant to Article 3 of the Judicial Notifications Law, as the means to receive notifications from judicial offices.

The exclusion is further based on Article 51, paragraph c), of the same regulation, which orders the removal from the lists of those who lose any of the registration requirements. In both cases, the Executive Directorate determined that the absence of a validated email constitutes a material breach which, by the principle of legality, prevents the professionals from remaining registered.

The Cases and Contact Efforts

Quesada Pacheco had been registered since 2003 and Aguilar Rodríguez since 2004. Following the update of the Management System for Auxiliaries of the Administration of Justice, which began on September 9, 2025, it was detected that both lacked a registered email address.

• Jorge Arturo Quesada Pacheco (ID 104200532): excluded from the Linguistics category.
• Luis Alberto Aguilar Rodríguez (ID 501990041): excluded from Agronomist Engineer and Private Brokerage and Real Estate Valuation.
• In the case of Aguilar Rodríguez, attempts to locate him by telephone (2680-0852 and 2680-3304) and fax were unsuccessful, with lines suspended or without a subscriber, both between October 25 and 28, 2025, and on July 16, 2026.

Appeals and Notification

The resolutions are subject to ordinary appeals for reversal before the same instance and appeals before the Director of the Executive Directorate, either alternatively or subsidiarily. The deadline to file them is three business days starting from the day following the notification. Both decisions were signed by Nacira Valverde Bermúdez, Executive Sub-Director, and their notification was ordered three consecutive times in the Official Gazette La Gaceta.

The measure affects professionals providing judicial services throughout the country and underscores the Judiciary’s requirement to have electronic notification channels as a condition for remaining registered as judicial assistants, in line with the digitalization of judicial procedures.
