Executive Branch removes representatives in three foundations due to resignation and non-compliance

The Executive Branch has voided the appointments of its representatives to the Rhema Palabra Viva, Somos Uno, and Cuenca Buena Vista foundations, due to resignation or failure to comply with obligations. The decision is detailed in three agreements from the Ministry of Justice and Peace published in La Gaceta No. 173 on Monday, September 14, 2026.

The agreements are issued using the powers conferred by articles 140, paragraphs 3) and 18), and 146 of the Political Constitution, article 11 of Law No. 5338 Foundations Law, and Executive Decree No. 36363-JP, the regulation for said article. The regulations authorize the Executive to appoint representatives to foundations and to remove them when they fail to fulfill their obligations or when the Executive Branch considers it convenient and timely with justification.

Resignations in Somos Uno and Cuenca Buena Vista

Through agreement No. AMJP-0064-07-2026, Executive Agreement No. 100-MJP of May 26, 2011, which appointed Betsy Marcela Jiménez Guzmán (ID 1-1021-0317) as representative to the Somos Uno Foundation (legal ID 3-006-620765), was voided following her resignation communicated on June 16, 2025.

For its part, agreement No. AMJP-0112-07-2026 voided Executive Agreement No. AMJP-0186-11-2023, which appointed Martha Iris Zúñiga Jiménez (ID 5-0339-0344) as representative to the Cuenca Buena Vista Foundation (legal ID 3-006-840923), after she submitted her formal resignation.

Removal for Non-Compliance in Rhema Palabra Viva

Agreement No. AMJP-0110-07-2026 voided Executive Agreement No. 300-2017-JP of November 16, 2017, which appointed Edwin Omar Duartes Delgado (ID 7-0090-0562) as representative to the Rhema Palabra Viva Foundation (legal ID 3-006-746936). In this case, the removal is a response to the failure to comply with the provisions established in the regulation of article 11 of the Foundations Law, in its articles 6, paragraphs d), e) and g), and 7, paragraphs b) and c), together with the requirements of Circular No. A.J.-001-2025 regarding the Annual Work Report.

The unfulfilled obligations include:

• Submitting to the Comptroller General of the Republic the information that the Administrative Board must send in January of each year.
• Informing the Executive Branch of any act that harms the interests of the State and its institutions.
• Reporting on the management of state, private, or international assets or aid received by the foundation.
• Fulfilling any other obligation entrusted to them by the President of the Republic or the Minister of Justice and Peace.

Scope of the measure

The three agreements take effect upon their publication and were signed by the President of the Republic, Laura Fernández Delgado, and the Minister of Justice and Peace, Gabriel Aguilar Vargas. The measure strengthens state supervision over entities that manage public resources by ensuring that representatives of the Executive branch fulfill their accountability duties before the Comptroller General’s Office and the Executive Power itself.
