Por FactBox Admin

Plasencia nombra a Fernández Merchán concejal delegado de Transporte y Movilidad

The mayor of Plasencia, David Casimiro Dóniga Estévez, has appointed José Antonio Fernández Merchán as the delegated councilor for Transport, Mobility, and Traffic and has delegated to him the authorization of civil marriages. The decision is formalized in a Mayoral resolution dated September 24, 2026, and published in the Official Gazette of the Province of Cáceres number 0187, dated September 30, 2026. The announcement appears in Section I - Local Administration, with official reference CVE BOP-2026-4537.

The appointment completes the reorganization of municipal areas and the delegations conferred upon the members of the Corporation that the Plasencia City Council had approved via Mayoral Resolution on June 30, 2026. The councilor took office during the ordinary plenary session held on July 31, 2026, as stated in the announcement itself.

The resolution is issued under articles 21.1.a) and d) and 23.4 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and articles 43.4 and 5, 114 to 118, 120, and 121 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28.

Appointment and scope of delegation

The Mayoral agreement is structured into six sections that organize the appointment, the content of the delegation, its notification, plenary control, and its publication. The first designates the new head of the area and the second establishes the limits of the delegation.

  • FIRST: to appoint José Antonio Fernández Merchán as Delegated Councilor for Transport, Mobility, and Traffic.
  • SECOND: to delegate to the aforementioned councilor the powers of the Mayor regarding the services of the delegated matters, with the authority to direct and manage them in general, but without the authority to resolve through administrative acts that affect third parties.
  • THIRD: to delegate the authority for the authorization of civil marriage.
  • FOURTH: to notify the interested party of the resolution.
  • FIFTH: to report the resolution to the Plenary at the first session it holds.
  • SIXTH: to publish the resolution in the BOP of Cáceres.

The delegation therefore covers the direction and ordinary management of Transport, Mobility, and Traffic services, but expressly excludes the resolution of administrative acts with effects toward third parties, which remains in the hands of the mayor.

Authorization of civil marriages

The third section transfers to the councilor the authority that article 51 of the Civil Code, modified by Law 35/1994, of December 23, attributes to mayors regarding the authorization of civil marriage. The delegation must be documented, and it is sufficient that the marriage authorization record states that the councilor acted by delegation of the mayor.

This is a regulated competence of individualized application, separate from the ordinary management of the mobility area, which is incorporated into the same administrative act of reorganization.

Deadlines, notification, and plenary control

The effectiveness of the delegation is conditional upon the acceptance of the delegated body. Such acceptance is understood to be granted tacitly if the interested party does not make an express statement of non-acceptance within a period of three business days, counting from the day following that on which the resolution is notified to them.

The procedure is closed with two control steps: the communication to the Plenary in its first session and the full publication of the announcement in the Official Gazette of the Province of Cáceres, which provides general publicity to the appointment and the delegation of powers.

The appointment strengthens the municipal government structure of Plasencia by incorporating a councilor with express delegation into the area of Transport, Mobility, and Traffic, and allows the mayor to offload both the daily management of the service and the celebration of civil marriages onto them. For the residents, the practical effect is twofold: a single interlocutor for mobility matters and the possibility that civil weddings be authorized by delegation of the mayor, with documentary evidence of this circumstance in the corresponding minutes.
