Pierre De Saint Moulin replaces Pierre Brassinne at Elia and Fluxys
Por FactBox Admin

Pierre De Saint Moulin succeeds Pierre Brassinne as the representative of the federal government on the board of directors of Elia Transmission Belgium SA and as the federal government commissioner to Fluxys Belgium SA and Fluxys LNG SA. The change was formalized by two royal decrees of October 1, 2026, signed by King Philippe and countersigned by the Minister of Energy M. Bihet, published in the Belgian Official Gazette on October 12, 2026, under references C − 2026/007466 and C − 2026/007468. Both texts enter into force on the day of their publication in the Belgian Official Gazette.
Two distinct legal bases
The first decree, C − 2026/007466, is adopted in application of Article 9, § 10bis, paragraph 1, of the law of April 29, 1999, relating to the organization of the electricity market, inserted by the law of January 8, 2012. It concerns the board of directors of the electricity transmission system operator, designated by ministerial decree of January 13, 2020, as Elia Transmission Belgium SA.
The second, C − 2026/007468, is based on Article 8/3, § 1/3, of the law of April 12, 1965, relating to the transport of gaseous and other products by pipelines, also inserted by the law of January 8, 2012. It concerns the federal government commissioners to the designated operators, namely Fluxys Belgium SA and Fluxys LNG SA, designated by ministerial decrees of February 23, 2010, for the natural gas transmission network, the storage facility, and the LNG facility. The matter falls within the framework of the law of June 26, 2002, regulating the special rights attached to specific State shares in Distrigaz SA and Fluxys SA.
What the two decrees provide
- C − 2026/007466: honorable resignation of Pierre Brassinne from his mandate as representative of the federal government for the French linguistic role on the board of directors of Elia Transmission Belgium SA, and appointment of Pierre De Saint Moulin to the same functions.
- C − 2026/007468: honorable resignation of Pierre Brassinne from his mandates as federal government commissioner for the French linguistic role on the boards of directors of Fluxys Belgium SA and Fluxys LNG SA, and appointment of Pierre De Saint Moulin to these two mandates.
- In both cases, the resignation and appointment pertain to the French linguistic role and take effect on the date of publication in the Belgian Official Gazette.
- The minister responsible for Energy is charged with the execution of both decrees.
Background and opinions
Both texts rely on a series of precedents: the Royal Decree of December 17, 2012, regarding the appointment of federal government representatives to the board of directors of the electricity transmission system operator, the Royal Decree of January 31, 2021, for government commissioners to the designated operators, and above all, the Royal Decree of October 17, 2025, concerning the resignation and appointment of the same categories of mandate holders. The 2026 rotation is therefore part of a recent sequence of renewals of federal oversight.
For both decrees, the opinion of the Inspector of Finance was given on September 14, 2026. The texts were adopted on the proposal of the Minister of Energy and after the opinion of the ministers meeting in Council.
Scope
The architecture of federal oversight of the electricity grid and gas infrastructures remains unchanged: only the French-speaking mandate holder changes, as the representation of the federal government to Elia Transmission Belgium SA, Fluxys Belgium SA, and Fluxys LNG SA remains the channel through which the federal State monitors the decisions of the designated operators. For market players and energy regulation observers, the publication of October 12, 2026, sets the effective date of the transfer and closes the transition opened by the Royal Decree of October 17, 2025.
