Pesca extingue la autorización de la granja marina Marsan en Santa Pola

The Directorate General of Fisheries has terminated the aquaculture activity authorization of the marine farm owned by Promociones Marsan, SL, registration number 03/029/000, located off the coast of the municipality of Santa Pola (Alicante). The resolution, signed on September 17, 2026, by the Director General of Fisheries, Miguel Francisco Castell Rovira, is published in the Official Gazette of the Generalitat Valenciana (DOGV) No. 10465, of October 5, 2026, within section III of administrative acts. The file, AM/03.029, is closed following the loss of the maritime-terrestrial public domain concession, an indispensable requirement to maintain the aquaculture authorization.

The original authorization was granted via the Resolution of March 25, 2003, from the Directorate General of Fisheries and Agricultural Marketing, which allowed Promociones Marsan, SL to install a marine farm establishment in Santa Pola (DOGV 4.486, 04.24.2003). The authority to resolve these procedures corresponds to the head of the general directorate with competence in maritime fisheries and aquaculture, according to Article 26 of Law 5/2017, of February 10, on maritime fisheries and aquaculture of the Comunitat Valenciana, and Article 5.2 of Decree 236/2022, of December 30, of the Consell.

The procedure was initiated ex officio under Article 58 of Law 39/2015, of October 1, on the common administrative procedure of public administrations.

From bankruptcy proceedings to the loss of the concession

The Commercial Court number 3 of Alicante declared the voluntary abbreviated bankruptcy of Promociones Marsan, SL on November 15, 2016, appointing Abraham García Gascón as the bankruptcy administrator. The liquidation phase of the company became final, meaning the company lost its legal capacity to act.

Subsequently, by ministerial order of November 12, 2018, the Provincial Coast Service declared the extinction of the concession that the company had obtained by ministerial order of February 20, 2003. Without that concession over the maritime-terrestrial public domain, the aquaculture authorization lacked legal support.

Fifteen-day period without allegations

On June 10, 2026, the agreement to initiate the file for the extinction of the aquaculture activity authorization was issued, granting a period of fifteen days from the day following its receipt to make allegations and present any documentation deemed relevant.

The period elapsed without the interested party appearing or presenting any allegation. On August 19, 2026, the territorial director of the Department of Agriculture, Livestock and Fisheries of Alicante issued a report and proposal in favor of the extinction.

Administrative appeal within one month

This resolution does not exhaust administrative remedies. An appeal for reversal (recurso de alzada) may be filed before the regional secretary of Agriculture, Water, Livestock and Fisheries within one month starting from the day following its notification, in accordance with articles 121 and 122 of Law 39/2015, of October 1.

The extinction leaves an aquaculture facility on the coast of Santa Pola without authorized activity and confirms the chain effect that the liquidation of a company and the loss of the coastal concession have on the aquaculture sector of the Comunitat Valenciana.
