Paterna de Rivera opens the application period to elect a Justice of the Peace

The City Council of Paterna de Rivera has opened a fifteen-business-day window to submit candidacies for the position of Justice of the Peace, both principal and substitute. The call, published in the Official Gazette of the Province of Cádiz number 175, dated September 10, 2026, responds to a requirement from the High Court of Justice of Andalusia.
The announcement, signed by the mayor-president Andrés Clavijo Ortiz, establishes that the appointment proposal will be the responsibility of the Plenary of the City Council, which must adopt it with an absolute majority quorum once the application period has elapsed.
Requirements for Applicants
Interested parties must prove that they meet the necessary requirements for the performance of the position, which are detailed in the announcement itself:
- Be Spanish and of legal age, providing a photocopy of the DNI (National ID).
- Not be subject to the causes of incapacity provided for in Article 303 of the Organic Law of the Judiciary.
- A law degree is not required.
- Not be subject to the causes of incompatibility in Article 389 of the Organic Law of the Judiciary.
Deadline and Submission of Applications
The fifteen-business-day period will begin to count from the day following the publication of the announcement in the Official Gazette of the Province. The application form is available to interested parties at the Municipal Registry of the Most Excellent City Council and on its Electronic Office, in the Public Employment Offer section.
Along with the application, applicants must provide their full identification data, especially the profession or trade they practice, attach a photocopy of the DNI, and submit a sworn statement that they are not subject to any cause of incapacity or incompatibility, and may provide documentation accrediting merits.
Incompatibilities of the Position
The announcement recalls the causes of incompatibility that exclude one from the position, which include:
- Exercising any other jurisdiction outside that of the Judiciary.
- Holding positions of popular election or political appointment of the State, Autonomous Communities, Provinces, and other local entities.
- Holding paid employment or positions within the State Administration, the General Courts, the Royal Household, Autonomous Communities, Provinces, or Municipalities.
- Holding employment in the Courts and Tribunals of any jurisdictional order.
- The practice of Law and Court Representation (Procuraduría), as well as all types of legal advice.
- The exercise of any commercial activity, whether on their own behalf or for another.
Those who, while being in any of these situations, are appointed, must choose between one position or the other within eight days or cease the exercise of the incompatible activity.
Relevance of the Position
The election of the Justice of the Peace is of special importance for the municipality, as this figure guarantees the administration of local justice in towns that lack their own court. The call for applications, processed at the request of the High Court of Justice of Andalusia, will allow for the renewal of both the primary and substitute positions, ensuring the continuity of the judicial service in Paterna de Rivera.
