Por FactBox Admin

The Plenary of the Parres City Council, meeting in an extraordinary session on October 23, 2026, definitively approved the list of assets and rights requiring occupation to execute phase 3 of the Arriondas Flood Defense project. The agreement is published in the Official Gazette of the Principality of Asturias (BOPA) No. 214, of November 5, 2026, section IV (Local Administration), under official reference Code 2026-09017, and formally declares the need for occupation and initiates the expropriation proceedings via the urgency procedure.
A project approved in March and exhibited in August
The file, processed under number 34016W and reference SEC/2024/169, originates from the resolution of the Directorate General for Water of the then Ministry of Ecological Transition, Industry and Trade, dated March 7, 2025, which approved the phase 3 project, focused on increasing the hydraulic capacity of the Río Chico and the removal of urban barriers. The file also includes Resolution 517/2025/4113, of March 7, 2026, approving the project by the Principality of Asturias.
On August 18, 2026, the Plenary initially approved the list of assets, which was open for public inspection for twenty days starting the day after its publication in BOPA No. 167, of August 28, 2026, with announcements also posted on the municipal notice board and in the newspaper El Comercio, as well as personal notification to the owners. It was not possible to locate the owners of plot no. 3, therefore an announcement was published in the BOE No. 228, of September 15, 2026.
Allegations: one accepted and three rejected
The Municipal Technical Architect, Marcos Montero Fernández, issued reports on October 2, 2026, regarding the allegations presented. The Delegated Department of Urban Planning and Heritage formulated a proposal on October 15, and the Permanent Information Commission for Urban Planning, Infrastructure, Public Services, Environmental Policies and Heritage issued its ruling on October 20. The result was:
- The allegation of Leonor María Blanco Fernández (property no. 8, cadastral ref. 2870006UP2036S0001OO) was upheld: as the resulting plot does not reach the minimum area required to realize urban development, the entire property will be expropriated.
- The allegation of Teresa Llamazales Perera (property no. 1) was dismissed, as the location and actual area of the asset were not documented.
- The allegations of Julia María González Suárez and Marta María González Suárez (properties no. 5 and 10) were dismissed: the layout is fixed by the approved project and the City Council has no authority to modify it; the price will be determined when fixing the fair price.
- The allegation of José Camilo Ángel Suárez del Valle (property no. 11) was dismissed, as the City Council lacks the authority to rectify cadastral data.
The vote concluded with 9 votes in favor (6 PSOE, 2 IU, and 1 Foro), none against, and 4 abstentions (3 PP and 1 Cs).

The City Council will request the Governing Council of the Principality of Asturias to declare urgent occupation under Article 52 of the Forced Expropriation Law of December 16, 1954, with the mayor-president as the Administration’s representative and the municipal technical architect as the expert. Owners who do not appear will be referred to the Public Prosecutor’s Office, and acquisition by mutual agreement will be governed by the expropriation law regulations.
Reasons: an extreme flood risk zone
Municipal reports justify the urgency on the grounds that the confluence of the Sella and Piloña rivers in Arriondas is identified as an area of potentially significant flood risk (ARPSI ES 018 AST-46-1). The Flood Risk Management Plan, approved by Royal Decree 20/2016, of January 15, classifies the hazard and risk of the area as extreme and includes it in Group I, the group with the greatest flood problems in the basin. The declaration of public utility of the works is understood to be implicit due to its inclusion in the Measures Program of the Hydrological Plan of the Western Cantabrian Hydrographic Demarcation (2015-2021 revision), in the section on structural flood protection measures in Arriondas.
The agreement concludes the administrative process: an appeal for reversal may be filed before the same body within one month, or a contentious-administrative appeal may be filed before the Contentious-Administrative Court within two months.
The decision directly affects a dozen owners and rights holders in Parres, whose lands will be occupied before the fair price is determined and who face an urgency procedure with reduced deadlines. For the rest of the residents, the agreement is the administrative step that unlocks works declared to be of general interest in the face of a flood risk categorized as extreme in the center of Arriondas.
