Ocaña approves the Local School Council for educational participation

The Ocaña City Council has finalized the Regulations of the Local School Council, a collegiate body for participation and consultation of the educational community in the general programming of non-university education in the municipality. The initial plenary agreement was automatically finalized as no claims were filed during the public exhibition period, and its full text is published in the Official Gazette of the Province of Toledo, number 164, dated August 28, 2026.

The publication is carried out in compliance with Article 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and the document bears the verification code 2026.00003827. The regulations, signed by Mayor Juan José Rodríguez Hernández on August 10, 2026, stem from a constitutional mandate and educational regulations that define participation as a principle of the educational system.

Regulatory Framework

The new body is established within the framework of the Spanish Constitution of 1978 and Organic Law 8/1985, of July 3, regulating the Right to Education, as well as Organic Law 2/2006, of May 3, on Education. At the regional level, it is supported by Law 3/2007, of March 8, on Social Participation in Education in the Autonomous Community of Castilla-La Mancha, and Decree 325/2008, of October 14, which regulates the organization and functioning of Local School Councils.

The Council shall also be governed by the provisions for collegiate bodies in Law 40/2015, of October 1, on the Legal Regime of the Public Sector. Its objective is to implement a democratic channel so that the citizens of Ocaña can participate in the programming and management of non-university education in the municipality’s educational centers.

Composition of the Council

The body shall consist of a president, a secretary, and councilors. The presidency is held by the mayor or the person to whom they delegate, while the secretary shall be a person in the service of the City Council designated by it. The councilors shall be:

• One representative from each municipal group with the status of councilor.
• One representative of the Educational Administration.
• The directors of Early Childhood, Primary, Secondary, Nursery Schools, Adult Education, and Special Education centers, whether public or state-subsidized (concertados).
• One representative of the parents of each center through the parents’ associations.
• One student from each center that provides Secondary Education.
• One representative of the administration and services staff of each public center.

The term of office for the councilors shall be four years, renewing at the beginning of each legislature. Vacancies shall be filled by the organization or sector to which the candidacy corresponds, for the remaining term of office and within a maximum period of two months.

Functions and organization

The Council shall be consulted on matters such as the development of city educational projects, the programming of complementary and extracurricular activities, the identification of educational needs, the creation or elimination of school places, the planning of municipal actions regarding centers, and the organization of transport and dining services. It shall also collaborate in the promotion of coexistence, equality between men and women, and the prevention of absenteeism and school bullying.

The body is organized into a Plenary, a Permanent Commission, and an Absenteeism Commission, in addition to other working commissions that may be created. It shall meet in Plenary on an ordinary basis at the beginning of the school year and on an extraordinary basis when requested by one-third of its members. Decisions shall be adopted by a simple majority of those present when consensus is not possible.

Relevance for the municipality

The entry into force of the regulation makes Ocaña a municipality with an institutionalized channel for families, teachers, students, and administrative and service staff to participate in educational decisions at the local level. An administrative appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Castilla-La Mancha based in Albacete, within two months from the publication of the announcement.
