The TAIC orders ALESUNI ECOM to pay 246,465 euros to ULMA

The Arbitration Tribunal for Industry and Construction (TAIC) fully upheld the claim filed by ULMA C. y E. S. Coop (CIF F-20.023.065) against the company ALESUNI ECOM, S.L. (CIF B01812577), in an arbitral award issued in A Coruña on July 28, 2026. The resolution, which terminates a lease agreement and orders the return of equipment, was notified through its publication in the Official Gazette of the Province of A Coruña on September 8, 2026, under reference 2026/5783.
The claim, filed before the Management of the TAIC, sought a total amount of 246,465.85 euros and the return of the leased equipment. The appointed sole arbitrator, lawyer María Luz Villares López, communicated that she had no conflict of interest and accepted the appointment, and following the relevant procedures, the arbitration hearing was held on the indicated date.
The ruling of the award
The award, which fully upholds the claim of ULMA, declares the lease agreement signed between the parties on May 8, 2025, terminated and imposes several penalties on the defendant:
- Return the leased equipment not yet returned within a maximum period of 10 days from the notification of the award.
- Should this not be done within that period, pay the value of the non-returned equipment, fixed at 223,264.33 euros.
- Pay 23,201.52 euros in concept of rents due until the filing of the claim.
- Pay daily rents from May 1, 2026, until the return of the equipment, or until the payment of its value, at a rate of 88.75 euros per calendar day plus VAT.
- Pay interest in accordance with the delinquency regime for commercial operations.
- Assume the costs of the arbitration.
Subsidiary notification
As it is recorded in the proceedings that notification attempts were made to the defendant via postal mail without being successfully carried out with all their effects, the award was notified through its publication in the official gazette, on a subsidiary basis and as a last resort. The published content is limited to the strictly indispensable details for its purpose of notification.
ALESUNI ECOM, S.L. is hereby notified by means of the announcement and may obtain a full copy of the award and access the complete content of the proceedings via electronic communication to the TAIC Secretariat (secretaria@ta-ic.es) or by written request submitted by a representative with sufficient power of attorney. The announcement is signed in A Coruña on September 2, 2026, by Eva Busto Monteagudo, proxy for the TAIC.
