O Instituto Galego do Consumo empraza en Vigo por un expediente sancionador

The Galician Institute of Consumption and Competition summons the person interested in sanctioning proceeding 36S002/156/2026 to be notified by appearance, after personal notification could not be carried out. The announcement, signed by the head of the Pontevedra Consumption Service, Alfonso Diéguez García, is published in the Official Gazette of Galicia (DOG) no. 178, of September 18, 2026, on page 49598, within section VI (Announcements). The appearance must be made before the Vigo Consumption Unit within a period of ten days.

The summons is based on article 44 in relation to article 46 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, and on article 114 of Law 2/2012, of March 28, Galician law on the general protection of consumers and users. The regulation allows for the substitution of personal notification with an announcement in the official bulletin when the interested party cannot be located or when, having attempted notification at their home in accordance with article 40 of the same law, it could not be performed.

The notified act is the agreement to initiate a sanctioning proceeding, adopted by the head of the Pontevedra Consumption Service, a body dependent on the Galician Institute of Consumption and Competition. This is a market surveillance action regarding the defense of consumers, a competence that the regional Administration exercises through its provincial and local units.

A common practice of the provincial service

The Pontevedra Consumption Service frequently resorts to this mechanism to close files that cannot be notified personally. In recent months, it has published similar announcements in the DOG:

  • File 36S002/150/2026, announcement of August 11, 2026 (DOG no. 159, of August 24, p. 46423), also with appearance at the Vigo Consumption Unit.
  • File 36S001/157/2026, announcement of August 19, 2026 (DOG no. 163, of August 28, p. 46922), with appearance at the Pontevedra Consumption Unit.
  • Requirement 36R002/R-RDG/82/2026, linked to file 36R002/2754/2025, announcement of September 7, 2026 (DOG no. 176, of September 16, p. 49050), adopted by the Vigo Consumption Inspection.

To these are added the summons processed by the central services of the organization in Santiago de Compostela, such as the initiation agreement of the sanctioning procedure 15S001-135-2026, notified by appearance on September 14, 2026 (DOG no. 174, p. 48776).

The publication of this type of announcement has an immediate practical effect: it activates the calculation of administrative deadlines and opens the way for the sanctioning procedure to continue its processing even if the affected person does not collect the notification at their home. For consumers and businesses in the Vigo area, the announcement confirms that market surveillance regarding consumption remains active and that the files opened by the Galician Institute of Consumption and Competition advance with official publication as a form of notification.
