O Carballiño aproba o regulamento do seu viveiro industrial de empresas

The Carballiño City Council has definitively approved the Operating Regulations of the Industrial Business Incubator, the regulation that establishes the access regime, the procedure for the allocation of spaces, and the rules of coexistence for the facilities. The approval is published in the Official Gazette of the Province of Ourense on October 6, 2026, in section IV. Local Entities, and occurs without an express agreement of the plenary since no allegations were registered during the public exhibition.

The file had been provisionally approved by the plenary on March 2, 2026, and published in the BOP of Ourense no. 49, of March 13, 2026, as well as on the municipal notice board. The public exhibition period ended on April 29, 2026, without claims or suggestions; therefore, under article 17.4 of Legislative Royal Decree 2/2004, of March 5, the text is definitively approved. The announcement is signed by the mayor, Francisco José Fumega Piñeiro.

The incubator is defined as a temporary hosting structure for recently created companies or those in the project phase, with the purpose of favoring the birth and consolidation of industrial initiatives, promoting job creation, and dynamizing the productive fabric of the municipality and its area of influence.

A 389.63 square meter warehouse in the Business Area

The facilities are located in the Carballiño Business Area, in a newly constructed warehouse with a built surface of 389.63 square meters. The distribution includes:

  • Industrial incubator area, meeting room, and training classroom.
  • Office for the administration and management of the center.
  • Men’s and women’s restrooms, and changing rooms.
  • Corridor of 26.18 square meters.
  • Three workspaces: Warehouse 1 of 78.50 m², Warehouse 2 of 75.52 m², and Warehouse 3 of 78.50 m².

The City Council will provide water and electricity supply, cleaning, maintenance, and conservation of the center, as well as the use of the training room and the meeting room.

Requirements, scale, and valuation commission

Space may be requested by recent companies, incorporated at most twelve months before the request, and companies in the process of incorporation or new ones, which must be incorporated within a maximum period of six months from the admission resolution. The authorization will be for a maximum period of 48 months. Companies must have their registered and tax address in the Municipality of Carballiño or commit to transferring it within three months, and develop an activity of an industrial nature in accordance with Decree 37/2015, of March 12, and the CNAE-2009 classification (divisions 05 to 09, 10 to 33, 35, and 36 to 39). Harmful, unhealthy, or dangerous activities and those prohibited by urban planning ordinances are excluded.

Selection will be carried out through a joint or continuous public call, and the Mayor’s Office will resolve it following the commission’s report. The Technical Evaluation Commission will be composed of the mayor as president, the deputy mayor and a municipal technician as members, with a civil servant as secretary with voice but without vote, and will meet ordinarily every two months. The scoring scale will award:

  • Technical and economic viability: up to 7 points (3.5 per section).
  • Innovation: up to 2 points.
  • Job creation: up to 7 points, with one point per full-time contract and 0.40 per part-time contract, with a minimum of three months.
  • Unemployment status of the promoter: 2 points.

Only projects that reach at least half of the maximum score will be admitted.

Deadlines, guarantees, and sanctioning regime

The regulation establishes a strict calendar for the successful bidders:

  • Amendment of incomplete applications: 10 business days.
  • Allegations against the award proposal: 15 days.
  • Resolution and notification: maximum 3 months from the application, with negative administrative silence.
  • Formalization of the contract: 10 business days; occupation of the space: 20 business days.
  • Start of activity: 3 months from formalization.
  • Eviction after the extinction of the authorization: 10 business days.

Beneficiaries must deposit a guarantee equivalent to two monthly installments of the fee and subscribe to a civil liability policy with minimum limits of 300,000 euros for third-party damages and per victim, and guarantees for theft, fire, and breakage of 40,000 euros for the building and 10,000 for the contents. Minor infractions will be sanctioned with a warning or a fine of up to 750 euros; serious infractions, from 751 to 1,500 euros; and very serious infractions, from 1,501 to 3,000 euros, with prescription periods of six months, two years, and three years, respectively.

The regulation will enter into force after its publication in the provincial bulletin and once the period provided for in article 49 of Law 7/1985, of April 2, has elapsed. The Mayor’s Office is authorized to modify the regulation according to the needs that arise, and the text includes as Annex I the standardized admission application form.

The implementation of this regulatory framework is the prerequisite so that the three warehouses of the nursery can be assigned with objective criteria and clear deadlines, which opens the door to the installation of new industrial companies in O Carballiño and the creation of stable employment in the municipality.
