Nules definitively approves the general ordinance for municipal public prices

The Nules City Council has definitively adopted the general local ordinance regulating public prices, after the agreement initially approved by the Plenary on June 26, 2026, received no claims or suggestions. The full text is published in the Official Gazette of the Province of Castellón number 113, dated September 19, 2026, in the Local Administration section, with the official reference 04118-2026-U. The regulation will enter into force fifteen days after its full publication in the provincial gazette.
The edict, signed in Nules on September 17, 2026, by the mayor-president, David García Pérez, is issued in compliance with articles 49, 65, and 70 of Law 7/1985, of April 2, Regulating the Bases of Local Regime. The ordinance is supported by article 127 of the Revised Text of the Law regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5, and articles 41 to 47 of the same text, as well as Law 8/1989, of April 13, on Fees and Public Prices. The text consists of eight articles and a single final provision.
What is considered a public price
The ordinance defines public prices as the pecuniary considerations paid for services or activities within municipal competence provided under public law, provided that one of these circumstances occurs:
- That they are of voluntary request or reception for the administered parties.
- That they are also provided or carried out by the private sector.
Voluntariness is understood to be proven when the request is not imposed by legal or regulatory provisions and when the requested services are not essential for the private or social life of the applicant. Those who benefit from the service or activity are obliged to pay and, for these purposes, the applicants themselves are considered beneficiaries.
Amount and exceptions for social reasons
The amount of public prices must cover, at a minimum, the cost of the service provided or the activity carried out. However, the Nules City Council may set prices below that limit when there are reasons that advise it, including:
- Social reasons, linked to the protection of individuals and groups in situations of economic or social vulnerability.
- Charitable reasons, linked to non-profit activities of assistance or support for needy people.
- Cultural reasons, related to the promotion, dissemination, or conservation of cultural, artistic, or historical heritage.
- Reasons of public interest, referring to actions that contribute to general welfare, citizen participation, coexistence, or sustainable development.
Any determination of the amount must be accompanied by an economic-financial study justifying the proposed amount and the degree of cost coverage.
Who decides each price and how it is charged
The approval and modification of the general ordinance is the responsibility of the Corporation’s Plenary, while the establishment of each specific public price and its specific regulation are delegated to the Local Government Board. The procedure shall require, at a minimum, a commencement order for the file, a report from the department or area with a signed economic-financial memorandum, a proposal from the corresponding council office, an intervention report, an opinion from the Information Commission, and an agreement from the Local Government Board. Agreements for the establishment or modification of rates shall be published in the Official Provincial Gazette.
Each agreement must detail the service or activity, the factual circumstance that generates the consideration, its amount, those obligated to pay, and the payment terms and conditions. The obligation to pay arises from the moment the service is requested, and debts may be demanded through the administrative enforcement procedure in accordance with Royal Decree 939/2005, of July 29, and Law 58/2003, of December 17, General Tax Law. For matters not provided for, Law 8/1989 shall apply supplementarily.
Entry into force and appeal process
The sole final provision establishes that the ordinance shall enter into force fifteen days after its full publication in the provincial gazette and shall remain in effect until its express modification or repeal. A contentious-administrative appeal may be filed against the final approval within two months from the day following the publication of the announcement, according to article 46.1 of Law 29/1998, regulating the Contentious-Administrative Jurisdiction.
The regulation affects any resident who uses municipal services or activities subject to a public price, as it sets the common framework for what is charged, how the amount is calculated, and which body approves it. By delegating the fixing of each specific rate to the Local Government Board, the Nules City Council streamlines the updating of prices, but maintains the requirement for an economic memorandum and an intervention report before any new charge.
