MTC grants Novanet Perú unique telecommunications concession for twenty years
Por FactBox Admin

The Ministry of Transport and Communications granted the company NOVANET PERU S.A.C. a Single Concession for the provision of public telecommunications services for a term of twenty (20) years, in an area comprising the entire territory of the Republic of Peru. The decision was formalized through Ministerial Resolution No. 606-2026-MTC/01.03, signed in Lima on October 23, 2026, by Minister José Angello Tangherlini Casal and published in the Legal Norms section of the Official Gazette El Peruano on Monday, October 26, 2026.
Services the new operator may provide
The resolution establishes that the first two services to be provided will be in the following modalities:
- Local carrier service, in switched modality.
- Public cable broadcasting distribution service, in wired or optical cable modality.
The first article specifies that the authorization covers the provision of public telecommunications services in general, while the preamble of the regulation recalls that, if the concessionaire requires the provision of additional services beyond the two initially declared, it must comply with the provisions of Article 155 of the General Regulations of the Telecommunications Law and request the Ministry to register said services in the registry enabled for such purpose.
28-clause contract and 60-business-day deadline
The second article of the resolution approves the Single Concession Contract to be entered into with NOVANET PERU S.A.C., which consists of twenty-eight (28) clauses. The third article authorizes the Director General of the General Directorate of Communications Programs and Projects to sign said contract on behalf of the Ministry and, should any of the parties request it, the public deed of the contract and its addenda.
The fourth article sets an express resolutory condition: the granted concession shall be null and void by operation of law if the contract is not signed by the company within a maximum period of sixty (60) business days from the publication of the ministerial resolution. To sign, the concessionaire must first comply with the payment of the concession fee. The fifth article provides for sending a copy of the regulation to the General Directorate of Communications Inspections and Sanctions for their knowledge and purposes.
The file and reports that supported the decision
The application was submitted via registration document No. T-324183-2026. According to the recitals, the General Directorate of Communications Programs and Projects, through Memorandum No. 1401-2026-MTC/27 and Report No. 0982-2026-MTC/27.02, verified compliance with legal requirements and concluded that the request was admissible. The General Office of Legal Counsel, via Report No. 1206-2026-MTC/08, issued a pronouncement considering the granting to be legally viable.
The invoked regulatory framework includes:
- The Single Ordered Text of the Telecommunications Law, approved by Supreme Decree No. 013-93-TCC, and its modification by Law No. 28737 (articles 47, 53, and numeral 3 of article 75).
- The Single Ordered Text of the General Regulations of the Telecommunications Law, approved by Supreme Decree No. 020-2007-MTC (articles 121, 143, 144, and 155).
- The Organization and Functions Regulations of the sector, approved by Ministerial Resolution No. 658-2021-MTC/01, and the Ministry’s TUPA, approved by Supreme Decree No. 009-2022-MTC.
A second operator enabled on the same day
In the same edition, the Ministry of Transport and Communications published Ministerial Resolution No. 607-2026-MTC/01.03, which grants a unique concession in equivalent terms—also for twenty years and throughout the national territory—to INVERSIONES Y SERVICIOS GENERALES ORAMITEL S.A.C., with a contract of twenty-eight clauses and the same term of sixty business days to sign it, following registration document No. T-296726-2026.
The enablement of NOVANET PERU S.A.C. incorporates a new operator with national coverage in local telephony and cable television, two segments where competition is concentrated among a few companies. The sixty-business-day term makes the signing of the contract and the payment of the concession fee the next verifiable milestones: without them, the concession becomes null and void by operation of law, and the operator will not be able to deploy networks or market services in the country.
