MTC approves expropriation of land for Tarapoto airport

The Ministry of Transport and Communications (MTC) approved the execution of the expropriation of the affected area of a real estate property necessary for the construction of the “Cadete FAP Guillermo del Castillo Paredes” Airport, located in the district of Tarapoto, province and department of San Martín. The decision was formalized through Ministerial Resolution No. 467-2026-MTC/01.02, dated September 2, 2026, published in the Official Gazette El Peruano on Thursday, September 3, 2026.

The regulation, signed by Minister Rafael Rey Rey, sets the appraisal value of the affected area at S/ 5,527.16 (five thousand five hundred twenty-seven soles and sixteen cents), corresponding to code PM1G-AERTARAPOTO-PU-242.

Legal Framework of the Expropriation

The measure is based on the Fifth Final Complementary Provision of Law No. 30025, which declares the execution of the airport infrastructure work as a matter of public necessity and authorizes the expropriation of the real estate properties necessary for such purpose. It is also framed within Legislative Decree No. 1192, the Framework Law for the Acquisition and Expropriation of Real Estate, and Legislative Decree No. 1569, which authorizes entities of the Transport Sector to directly set the appraisal value of properties for projects prioritized in the National Sustainable Infrastructure Plan for Competitiveness (PNISC) 2022-2025.

The appraisal value was determined by the appraisal expert, contracted under the scope of the Fifth Final Complementary Provision of Legislative Decree No. 1569, through the Technical Appraisal Report with code PM1G-AERTARAPOTO-PU-242, which received the approval of the supervising expert via Technical Conformity Report No. 04241-2026-DDP/CSM.

Parties and Procedure

The following parties are involved in the procedure:

• Active Party: the Ministry of Transport and Communications, responsible for processing the expropriation procedure.
• Passive Party: the owners or possessors of the affected property, whose property right is registered in the Property Registry of the National Superintendency of Public Registries (SUNARP).
• Beneficiary: the State, acting through the public entity in charge of the project.

The resolution mandates the deposit of the appraisal value in the Banco de la Nación in favor of the passive parties, within sixty (60) business days following its issuance. Likewise, it orders the registry registration of the expropriated area in favor of the beneficiary and the removal of any charge or lien contained in the registry entry.

Delivery and Notification Deadlines

The General Directorate of Transport Programs and Projects, through the Directorate of Land Availability, shall notify the taxpayers of the resolution, requiring the vacation and delivery of the expropriated area:

• Ten (10) business days following the notification, if the area is unoccupied.
• Thirty (30) business days, if the area is occupied or in use.

In case of non-compliance, notice is given regarding the initiation of coercive execution procedures for the eviction or taking possession of the expropriated area.

Impact

The approval of this expropriation constitutes a key step for the execution of an airport infrastructure project declared of public necessity, which seeks to modernize air connectivity in the San Martín region. For the affected owners, the regulation guarantees the payment of a fair appraisal compensation and establishes clear deadlines and procedures for the delivery of the land, within the framework of the Framework Law for Acquisition and Expropriation.
