Por FactBox Admin

The Regional Ministry of Mobility, Environment and Emergency Management of the Principality of Asturias has ordered the execution of final judgment 446/2026 of the High Court of Justice of Asturias, which dismisses the appeal of the expropriated party against the fair price set by the Expropriation Jury of the Principality of Asturias for the works on the AS-318 road. The resolution, signed by the regional minister Alejandro Jesús Calvo Rodríguez on October 1, 2026, is published in the Official Gazette of the Principality of Asturias no. 201, of October 16, 2026, with reference Code 2026-08175.
The judicial ruling being executed
The High Court of Justice of Asturias issued judgment number 00446/2026, dated May 5, 2026, in the contentious-administrative appeal number P. O. 960/2024, filed by J. M. A. A., represented by the court agent M. G. B., against the agreement of the Expropriation Jury of the Principality of Asturias.
The ruling, reproduced literally in the regional resolution, agrees:
- To dismiss the contentious-administrative appeal filed against the agreement of the Expropriation Jury no. 2024/257.
- To confirm said resolution as being in accordance with the law.
- Not to impose legal costs.
With the certificate of finality already issued, the judgment acquires a definitive character and the Administration is obliged to comply with it in its own terms.
The origin: plot 0080-0 and the AS-318
The litigation dates back to the agreement of the Expropriation Jury of the Principality of Asturias of October 11, 2024, number 2024/0257, which set the fair price for plot no. 0080-0. The land was expropriated for the project “Widening and improvement of the AS-318 road la Arena-Ranón (Municipalities of Castrillón and Soto del barco)”, a road action affecting the municipalities of Castrillón and Soto del Barco.
The expropriated party appealed the valuation before the contentious-administrative jurisdiction, but the court has fully supported the decision of the appraisal body, so the amount set via administrative channels remains unchanged.
The legal framework of the execution
The resolution invokes Article 17.2 of Organic Law 6/1985, of July 1, of the Judiciary, which obliges public administrations to respect and comply with final or executable judicial judgments and resolutions in accordance with the law.
To process the compliance, the provisions of Article 26 of Decree 20/97, of March 20, which regulates the organization and functioning of the Legal Service of the Principality of Asturias, are applied. The operative part of the resolution is limited to two mandates: to execute the ruling in its own terms and to order its publication in the Official Gazette of the Principality of Asturias.
Closing
The publication closes the litigation regarding the fair price of this property and confirms the position of the Expropriation Jury against the owner’s claims, with no costs awarded to either party. For those affected by expropriations for the improvement of the AS-318, the ruling reinforces the presumption of accuracy of the Jury’s valuations and exhausts the ordinary judicial route, such that only the material execution and the payment of the already fixed amount remain.
