Montmeló definitively approves the ordinance regulating the use of pyrotechnics

The plenary of the Montmeló City Council, in an ordinary session on March 31, 2026, initially approved the ordinance to regulate the use of pyrotechnics in the municipality, and the text was definitively approved on May 27, 2026, after the public exhibition period ended on May 26 without any claims or allegations. The regulation is published in the Official Gazette of the Province of Barcelona on September 17, 2026, with the official reference CVE 202610140364 and seven pages of text.

According to the statement of reasons, the ordinance responds to requests from various entities, collectives, and citizens who have highlighted the impacts of pyrotechnics on human health, animal welfare, and the preservation of the natural environment. The text also aims to resolve the lack of a specific and clear municipal regulatory framework determining what is permitted, in which spaces, at what times, and under what conditions.

The procedure complied with article 124.2 of the ROAS: the full text was submitted for public information with the publication in the provincial gazette on April 10, 2026, for a period of 30 business days. The regulation aligns with Royal Decree 989/2015, of October 30, which approves the Regulation of pyrotechnic articles and cartridges, and with European Directive 2013/29/EU.

Permitted categories and protected zones

The ordinance restricts the use of pyrotechnic material within the municipal boundary to two categories:

• F1: articles of very low hazard and insignificant noise level, for delimited areas, including those intended for residential buildings.
• F2: articles of low hazard and low noise level, for outdoors in delimited areas.

Any higher category will require express authorization from the Montmeló City Council. The text expressly excludes the sale of pyrotechnic articles and the use of explosive material transport vehicles as warehouses within the security zone.

The use of pyrotechnics is prohibited in the following protected zones:

• Forest areas and land with natural vegetation: Bosc de l’Aplec, Bosc de Can Guitet, and Bosc de la Torre Pardalera, as well as the entire river park, cultivated fields, and urban gardens.
• Security perimeters of at least 500 meters in natural spaces such as the Turó de les Tres Creus and the vegetated riverbank.
• The green zones indicated on the ordinance map and protected natural spaces (PEIN).

Dates, schedules, and acoustic limits

Outside of the provided exceptions, pyrotechnic material may not be used throughout the year. The permitted dates are:

• Sant Joan and Sant Pere Eve: June 23 from 18:00 to 23:59 h; June 24 from 00:00 to 03:00 h; June 28 from 18:00 to 23:59 h.
• Montmeló’s Festa Major and its Capvuitada, according to the annual holidays established by the council.
• New Year’s Eve, January 1, from 00:00 to 02:00 h.

Entities or associations wishing to hold fire events on different dates must submit a request specifying the date, time, location, and type of material; the authorization shall be resolved by the mayor or the delegated councilor, and in no case shall it be considered granted by administrative silence. Regarding noise, the ordinance refers to the municipal acoustic pollution ordinance, with outdoor emission guide values of 60/50 dBA in high sensitivity zones, 65/55 in moderate zones, and 70/60 in low zones.

Inspection and sanctioning regime

Complaints, whether verbal or written, will lead to inspection and control actions and, if appropriate, to the initiation of the corresponding sanctioning proceedings. The inspection may be carried out by municipal technicians, Local Police officers, and personnel from supra-municipal entities, who shall have the status of authority agents.

In case of non-compliance, the sanctioning regime of the civility ordinance of the Montmeló City Council, published in the provincial bulletin on March 2, 2022, will be applied, without prejudice to precautionary measures such as the seizure of dangerous materials. The sanctioning power corresponds to the mayor, with processing in accordance with Law 39/2015, of October 1.

The ordinance will enter into force upon publication in the provincial bulletin and once the period of fifteen business days from article 65.2 of Law 7/1985, of April 2, has elapsed. Against the act, which exhausts the administrative route, a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Catalonia within a period of two months. The mayor, Pere Rodríguez Rodríguez, signed the announcement on August 6, 2026.

The regulation closes years of neighborhood debate and responds to the demands collected in the statement of reasons, and for the first time sets in writing what can be launched, where, and at what time in Montmeló. The impact is direct for entities, groups, and neighbors: it limits daily use to categories F1 and F2, protects forests, the river park, and PEIN spaces, and concentrates exceptions on the revetlles, the Festa Major, and New Year’s Eve.
