Montijo definitively approves its peri-urban fire prevention plan

The Montijo City Council has definitively approved the municipality’s Peri-urban Forest Fire Prevention Plan, by Mayoral resolution dated September 14, 2026. The decision is published in the Official Gazette of the Province of Badajoz number 177, dated September 16, 2026, under announcement 3612/2026.

The plan, developed with the technical assistance of the Provincial Council of Badajoz within the framework of a management entrustment agreement, aims to establish concrete measures to prevent forest fires in the urban environment of the municipality, in accordance with Article 31 of Law 5/2004, of June 24, on the prevention and fight against forest fires in Extremadura.

Processing and Approval

The Plenary of the Montijo City Council agreed to the initial approval of the plan in a session held on May 7, 2026. The file was subject to public consultation for thirty business days via an announcement published in the Official Gazette of the Province of Badajoz number 109, dated June 10, 2026, without any allegations, claims, or suggestions being presented, a circumstance certified by the General Secretariat of the City Council on July 24, 2026.

Subsequently, the General Directorate for the Prevention and Extinction of Forest Fires of the Regional Government of Extremadura approved the plan by resolution dated August 25, 2026, issued in file PP/0199/2026, in accordance with the aforementioned Law 5/2004, Decree 260/2014, of December 2, which regulates forest fire prevention in the community, and the Order of October 24, 2016, regarding the technical aspects of the forest fire prevention plan.

Effects and Validity of the Plan

The plan shall have indefinite validity and will be subject to review every four years or whenever the circumstances provided for in the instrument itself occur, as established in Article 20 of Law 5/2004. Pursuant to Article 21 of the same regulation, the instrument is binding for both public administrations and private individuals, and its approval implies the declaration of public utility for the planned actions.

• The approval entails the need for the occupation of land or the acquisition of the necessary rights for its execution.
• These actions may be carried out for the purposes of expropriation or the imposition of easements.

Appeals and Publication

An administrative appeal may be filed directly against the final approval before the Administrative Chamber of the High Court of Justice of Extremadura, based in Cáceres, within two months from the day following the publication of the announcement, in accordance with Article 46.1 of Law 29/1998, of July 13, regulating the Administrative Jurisdiction. The announcement is signed by the Mayor-President, Javier Cienfuegos Pinilla.

The final approval of the plan reinforces the protection of Montijo’s urban environment against the risk of forest fires, providing the municipality with a planning instrument with binding effects and public utility that organizes preventive actions in the urban-forest interface.
