The Moclín City Council has provisionally approved the modification of its Ordinance regulating construction and demolition waste, which sets the required bond for new construction works at 2% of the PEM (Material Execution Budget) to guarantee the proper management of this waste. The agreement was adopted by the Plenary of the Corporation on August 6, 2026, and has been published in the Official Gazette of the Province of Granada number 175, dated September 10, 2026, via the public exhibition announcement with reference BOP-GRA-2026-175016.

The decision, processed under file 1171/2026, modifies article 8.1.b) of the ordinance, which was published in the Official Gazette of the Province on July 14, 2017. The announcement is signed by the mayor-president, Marco Antonio Pérez Mazuecos, and directly affects developers and builders initiating new construction works in the municipality.

A fixed percentage for the waste bond

The modification introduces a clear percentage criterion for calculating the bond that those promoting new construction works must deposit, with the aim of ensuring the correct management of the waste generated during execution. The new text of article 8.1.b) is drafted as follows:

  • For new construction works: a bond of 2% of the PEM (Material Execution Budget).

With this, the City Council replaces the previous criterion with a single and homogeneous percentage applicable to all new-build works, providing predictability for operators in the construction sector within the municipality.

Public exhibition and appeals process

The agreement is subject to public information for a period of 30 business days, counting from the day following the insertion of the announcement in the Official Gazette of the Province. During this period, interested parties may examine the file and submit any claims and allegations they deem appropriate.

  • The file can be consulted at the municipal offices of the Moclín City Council.
  • It is also available on the council’s electronic office (ayuntamientodemoclin.sedelectronica.es).
  • If no claims are submitted after the deadline, the agreement will be considered definitively approved, in accordance with article 17.3 of the Recast Text of the Law Regulating Local Treasuries (Royal Legislative Decree 2/2004, of March 5).

Setting the bond at 2% of the PEM introduces a predictable and quantifiable cost for any developer initiating a new construction project in Moclín, a municipality in the Los Montes Orientales region of Granada. The measure seeks to strengthen municipal control over the management of construction and demolition waste, in line with current environmental requirements, and obliges builders to account for this deposit in the economic planning of their projects.

The processing follows the ordinary procedure for the modification of fiscal and urban planning ordinances, such that final approval will be conditional upon no objections being filed during the public exhibition period. Interested parties therefore have one business month to review the text and submit their observations before the measure becomes definitive.
