Minister of Finance increases approved quantities of blue diesel by 17.5 percent

Deputy Prime Minister and Minister of Finance Tomislav Ćorić has signed the Ordinance on the Amendment to the Ordinance on the Application of the Excise Duty Act, which refers to blue diesel for use in agriculture, fishing, and aquaculture, as well as the refund of paid excise duties on unleaded motor gasoline for use in fishing. Exceptionally for the year 2026, the approved quantities of blue diesel are increased by 17.5% for users who had recorded consumption of blue diesel by July 15, 2026. The act was published in the Official Gazette (Narodne novine) no. 107/2026 of September 23, 2026, under number 1286.

What is changing and who is covered

The amendment consists of one new provision: in the Ordinance on the Application of the Excise Duty Act (“Official Gazette” no. 1/19, 80/20, 125/22, and 114/23), a new Article 25b is added after Article 25a. By this provision, exceptionally for the year 2026, the approved quantities of blue diesel from Article 8, paragraph 2 of that Ordinance are increased by 17.5%.
The measure can be utilized by users with recorded consumption by July 15, 2026, and it concerns three groups:

• farmers,
• fishermen,
• aquaculture entities.

Legal basis and deciding body

The Ordinance was adopted based on Article 103, paragraph 9, and Article 106, paragraph 6 of the Excise Duty Act (“Official Gazette” no. 106/18, 121/19, and 144/21), and was signed by the Minister of Finance with the consent of the Minister of Agriculture. This is, therefore, a fiscal measure under the jurisdiction of the Ministry of Finance, while the agricultural and fishing sectors are covered through the consent of the relevant ministry.

Entry into force and price context

The Ordinance enters into force on the first day following its publication in the “Official Gazette,” meaning it applies from the day following the publication on September 23, 2026. The amendment refers exclusively to the quantities of blue diesel; the provisions regarding the refund of paid excise duties on unleaded motor gasoline for use in fishing remain unchanged.
Blue diesel is simultaneously part of the system of maximum retail prices for petroleum derivatives. By the Decree on Determining the Maximum Retail Prices of Petroleum Derivatives (“Official Gazette” no. 102/2026), the maximum amount of the energy entity premium for blue diesel at gas stations outside motorways was set at 0.0236 EUR/l. The increase in approved quantities therefore acts on the quantity parameter, not the price parameter of consumption.

For farmers, fishers, and aquaculture, an increase of 17.5% means that with the same consumption records, they will be able to take larger quantities of blue diesel under the privileged excise treatment, thereby directly reducing operating costs in a year where energy prices remained under administrative supervision. The measure is time-limited until 2026 and linked to consumption recorded by July 15, 2026; therefore, it cannot be used by users who had no recorded blue diesel consumption during that period.
