Matabuena removes environmental protection from a property in Cañicosa

The Territorial Commission of Environment and Urbanism of Segovia definitively approved, by agreement on September 8, 2026, the specific modification of the Municipal Urban Planning Regulations of Matabuena (Segovia), which removes the environmental protection of the property located at calle Pozas no. 14 in Cañicosa. The decision, adopted unanimously, is published in the Official Gazette of Castilla y León number 179, dated September 15, 2026, with official reference BOCYL-D-15092026-179-14 (file NUM-SG-003/25 (AD)).

The modification, promoted by Pablo García García and M.ª Teresa Royo Velasco, leaves the building without a protection level and removes file no. 46 from the Catalogue of Protected Elements of the Municipality of Matabuena. The property, with cadastral reference 5309802VL3550N0001XB, may thus be rehabilitated and designated for new uses within the urban center of Cañicosa.

A building obsolete for habitability

The binding report justifies the decataloging due to the deteriorated state of the property and its obsolescence compared to current habitability standards. Technical documentation reveals that the building does not consist of a single floor of 120 m², as stated in the file, but of two floors of 125 and 86 m² respectively, both with a clear height of only 2 meters, which is insufficient according to current regulations.

• The only facade open to the access courtyard prevents adequate lighting and ventilation.
• The absence of data regarding the age of the building and alterations in the facade masonry reduce its historical value and authenticity.
• No elements of architectural value that merit conservation are observed.

The protection of the volumetry and the roof was incongruent with the surrounding environment of Cañicosa, characterized by taller buildings. The agreement invokes Article 37 of Law 5/1999, of April 8, on Urbanism of Castilla y León, which favors the improvement of habitability conditions and the rehabilitation of constructions.

A long administrative journey

The procedure began with the initial approval by the City Council Plenary in the session of September 11, 2025, followed by the public information process, during which no objections were presented. Provisional approval arrived on February 16, 2026, and the file was forwarded to the Territorial Service of Mobility and Digital Transformation on March 23, 2026.

On July 30, 2026, Order AGR/728/2026, of July 23, was incorporated, which formulates the Strategic Environmental Report, determining that it is unlikely that significant effects on the environment will occur, provided that the indications of the Duero Hydrographic Confederation are met. The favorable report from the Territorial Service was issued on August 31, 2026.

Previous favorable reports

During the processing, reports were gathered from various agencies, all of which raised no substantial objections:

• Territorial Service for Mobility and Digital Transformation: favorable on August 26, 2025.
• Territorial Service for Culture, Tourism and Sport: no impact on cultural heritage (April 11, 2025).
• Provincial Council of Segovia: no impact on provincial roads.
• Ministry for Digital Transformation and the Civil Service: favorable regarding telecommunications (April 3, 2025).

The agreement orders the publication of the approved instrument, the sending of a certified copy to the City Council of Matabuena, and the notification of the decision to the promoter, the State Administration, the Provincial Council, and the Property Registry. An administrative appeal may be filed against the agreement in accordance with Article 112 of Law 39/2015, of October 1.

Relevance for the municipality

The removal from the catalog opens the door to the rehabilitation of an abandoned building in the heart of Cañicosa, which originally played a key role in the local agrarian economy. For the residents of Matabuena, the decision represents an opportunity to recover a degraded space in the urban center and adapt it to contemporary uses, in line with the conservation and habitability improvement objectives pursued by the urban planning regulations of Castilla y León.
