Martos definitively approves the regulations of the Virgen de la Villa center for people with disabilities

The Martos City Council (Jaén) has made final the update of the internal regulations of the Adult Residence and the Day Stay Unit with Occupational Therapy “Virgen de la Villa”, both dependent on the city council and located at Calle La Villa s/n in the town. The two announcements appear in Official Bulletin of the Province of Jaén number 158, of August 17, 2026, with references 2026/3761 and 2026/3762.

The final approval comes after the Plenary City Council initially approved both regulations at its ordinary session of May 28, 2026, and after said approval was published in the BOP of Jaén number 114, of June 16, 2026. Once the legal period for filing claims or suggestions had elapsed without any being submitted, the mayor-president, Don Emilio Torres Velasco, has elevated the agreements to final status. An administrative contentious appeal may be filed against them within two months.

Two centers, one same objective

The Adult Residence “Virgen de la Villa” is a comprehensive care resource intended for the temporary or permanent accommodation and coexistence, in boarding regime, of people with disabilities who, having a certain personal autonomy, present difficulties for normalized family life and social integration due to family, educational, or occupational-labor reasons. Its regulation, composed of at least twelve articles, regulates rights, duties, and detailed operating rules, including room decoration, comprehensive care (lodging, meals, hygiene, psychological, medical-health, and social care), and the composition of each resident’s individual file.

The Day Stay Unit with Occupational Therapy “Virgen de la Villa” is a specialized social services center whose purpose is to foster social integration and provide useful activity to people of working age who, due to their severe temporary or permanent disability, cannot access ordinary or special jobs. The activities carried out do not imply an employment relationship with users. Its services include meals (breakfast, lunch, and afternoon snack), personal hygiene, assistance with daily activities, and psychological and social care.

Legal framework and updated rights

Both regulations are based on the same set of rules:

• Law 39/2006, of 14 December, on the Promotion of Personal Autonomy and Care for people in situations of dependency.
• Law 9/2016, of 27 December, on Social Services of Andalusia.
• Law 4/2017, of 25 September, on the Rights and Care of Persons with Disabilities in Andalusia.
• Order of 28 July 2000, jointly issued by the Ministries of the Presidency and Social Affairs, on requirements for social services centres.
• Decree 388/2010, of 19 October, on access to and transfer to places in residential, day and night centres.
• Decree-Law 3/2022, of 29 March, on urgent measures for the funding of care centres.
• Decree 41/2018, of 20 February, on social agreements for the provision of social services.

Rights and duties of users

The residence regulations recognise a broad catalogue of rights for users, including individual freedom regarding admission, stay and departure, intimacy and privacy, personalisation of their private space, free exercise of ideological, sexual and religious freedoms, not being subjected to immobilisation without medical prescription, and recognition of the centre as their home for all purposes. Among their obligations are the responsible use of services, collaboration with social intervention plans, providing truthful information and contributing to the funding of services according to economic capacity.

In the day care unit, rights include participating and being heard in decisions concerning their care, dignified treatment, professional secrecy, individualised care and the possibility of ceasing to use the services of their own free will. A disciplinary regime, hygiene and health standards, and protocols for urgent medical care are also established.

Services and practical operation

Both centres guarantee comprehensive care for users’ basic needs. In the residence, this includes accommodation, meals, daily hygiene, assistance with everyday activities and psychological, medical-health and social care. In the day care unit, services include meals across three daily servings, hygiene, assistance with activities and psychological and social care. Monthly dining room menus must be supervised by a physician to ensure adequate dietary intake.

The residence regulations detail the content of each user’s individual file, which includes identification data, family information, disability determination and degree of dependency, social, psychological and clinical history, and an individual comprehensive development programme. It is established that users may decorate their room, but must request permission to use electrical appliances, and smoking is prohibited in the rooms.
