Šmartno pri Litiji rewrites servitude fee formula and scraps article six

The Občinski svet Občine Šmartno pri Litiji has amended the ordinance governing how municipal real estate is encumbered with servitude rights, rewriting the single-payment compensation formula and deleting Article 6 outright. The change was adopted at the council’s 23rd regular session on 16 September 2026 and published in Uradni list Republike Slovenije št. 1459/2026 of 21 September 2026, under official reference EDA 2026-1779737000-0008.

The instrument is the Odlok o spremembah in dopolnitvah Odloka o obremenjevanju nepremičnega premoženja v lasti Občine Šmartno pri Litiji s služnostnimi pravicami, which amends the ordinance originally published in Uradni list RS št. 97/20 in 167/21. It rests on Articles 21, 29 and 65 of the Zakon o lokalni samoupravi, Articles 37, 70, 71 and 74 of the Zakon o stvarnem premoženju države in samoupravnih lokalnih skupnosti (Uradni list RS, št. 11/18 in 79/18) and Article 14 of the Statut Občine Šmartno pri Litiji (Uradni list RS, št. 70/18). The act carries the number 007-4/2026-4 and was signed by the mayor, Blaž Izlakar.

A new calculation for the single payment

Article 1 of the amendment replaces Article 5 of the ordinance in full. The party liable for the single payment is any legal or natural person who, as servitude beneficiary, acquires a servitude right over municipal real estate, and payment falls due within 30 days of the contract being concluded or the invoice being issued.

The amount is now built from three elements:

  • Vnpr — the value of the property per square metre.
  • Pnpr — the surface area encumbered by the servitude, calculated as the product of the corridor’s length and width.
  • Fo — the encumbrance factor.

The single payment (EN) is set by the formula EN = Vnpr x Pnpr x Fo. Both the property value and the encumbrance factor are determined by a valuation report drawn up by a competent and authorised appraiser of the relevant profession.

Official valuation above 10,000 euros

The amended Article 5 also sets out three situations in which the standard formula no longer applies and the fee must instead be fixed on the basis of an official valuation for the specific case:

  • The single payment empirically exceeds 10,000 euros.
  • The factor for a given type of encumbrance is not covered by the valuation report.
  • The planned intervention in the property would substantially reduce its value.

In these cases the cost of the valuation is borne by the servitude beneficiary.

Article 6 deleted and entry into force

Article 2 of the amendment deletes Article 6 of the parent ordinance, removing that provision from the text without replacement. Article 3 sets the transitional rule: the amending ordinance enters into force on the fifteenth day after its publication in the Uradni list Republike Slovenije, which places its application in early October 2026.

The reform matters beyond the municipal boundary because servitude holders over municipal land are typically network operators laying and maintaining water, sewerage, electricity and telecommunications infrastructure. For them the practical consequences are a formula tied to an appraiser’s report rather than to a fixed schedule, a 30-day payment deadline, and a valuation bill of their own whenever the 10,000-euro threshold, an uncovered encumbrance type or a serious loss of property value triggers the individual assessment.
