Maritime and Commercial Court summons absent director of SH service 88
Por FactBox Admin

The Sø- og Handelsretten, Denmark’s Maritime and Commercial Court in Copenhagen, has received a writ seeking a bankruptcy disqualification order against Shaban Sadula Halid, the person recorded in the gazette as having run SH service 88 and whose address is unknown. Because ordinary service proved impossible, the summons was published by public notice in Statstidende on 3 November 2026 in case BS-34026/2026-SHR. The defendant has four weeks from publication to respond.
The notice, signed by the court on 30 October 2026, states that the document is served publicly because other service “ikke har været mulig” and that the court has not been able to come into contact with the defendant. The writ and its annexes can be obtained from Sø- og Handelsretten at Amaliegade 35, 2. sal, 1256 København K, telephone 9968 4600.
Disqualification — konkurskarantæne — is the insolvency sanction that bars a person from taking part in the management of a business without personal and unlimited liability for its obligations, for up to five years. The court’s notice refers readers to sections 162 and 163 and to section 164(2) of the konkurslov and to the guidance published on the courts’ website; an order is entered in Erhvervsstyrelsen’s disqualification register, and breach can lead to liability for debt left uncovered by a later estate and to criminal punishment.
The estate behind the summons
A separate notice of 16 October 2026 records that the bankruptcy estate of Shaban Sadula Halid, CVR 44995190, holds no funds beyond what is needed to cover the costs of administration, under section 143 of the konkurslov, and that the estate will therefore be closed. The same notice states that he ran SH service 88 from Gyngemose Parkvej 20, 2. mf, 2860 Søborg under that CVR number, and gives his registered whereabouts as “Udrejst”, 9999 Københavns Kommune, unknown.
The closure is set for a creditors’ meeting in the probate division of Sø- og Handelsretten on 11 November 2026 at 12:00, case K 2772/25-E, with the accounts and vouchers open for inspection at the court office. The two tracks therefore run in parallel: the estate is being wound up for lack of assets while the personal sanction case against its former operator is only being served.
Deadlines and procedure
The order published on 3 November sets out a short procedural path for a defendant the court cannot reach:
- a defence must be uploaded within four weeks of publication at www.minretssag.dk;
- the defence must state an address that can be used for future contact with the court;
- the writ with annexes is available on request from the court in Copenhagen;
- guidance on what disqualification entails is published on Sø- og Handelsretten’s website.
A recurring pattern of public service
The case is one of several in which Danish courts have served disqualification process by public notice in Statstidende within the past month, each time after failing to trace the defendant. On 6 October the Retten i Aalborg published a writ against Jakob Daa Jensen in the estate of LittleThings.dk ApS (CVR 38335391), with the curator claiming three years; on 8 October Sø- og Handelsretten published one against Ahmed Ibrahim Hussein Kassab in the estate of YMD Trading ApS (BS-15710/2026-SHR); on 13 October it published another against Jason Coyle in the estate of RedCo Fishing ApS (BS-42685/2025-SHR).
On 23 October the Retten i Svendborg gave notice that curator Boris K. Frederiksen seeks five years against Thageeshan Theiventhiramoorthy in the estate of Marketizer ApS (CVR 42819220), whose last known address was in Dubai, and on 27 October the Retten i Aarhus published a three-year claim against Sinan Al-Karradi in the estate of Sinka Holding ApS. In each case the mechanism is identical: four weeks to answer on www.minretssag.dk, an address for future contact, and a ruling on the papers if no defence arrives.
Why it matters
For creditors and for the public register, published service is the only route left when a director cannot be found: the sanction can still be pursued provided the process is announced where it can be read. The writ against Shaban Sadula Halid will test that route in a case where the estate itself has nothing left to distribute and the sole remaining object of the litigation is his personal eligibility to run a company.
