Malpartida de Cáceres imposes a 1,000-euro fine for a sanitary waste discharge.

The City Council of Malpartida de Cáceres has resolved to impose a fine of 1,000 euros on Mr. Juan Carlos Hinojal Santos for the dumping and deposit of sanitary ware outside the municipal Clean Point, events that occurred on March 6, 2026. The resolution of the penalty proceeding, signed on August 10 by the Mayor-President, Alfredo Aguilera Alcántara, is published in the Official Gazette of the Province of Cáceres number 155, of August 14, 2026, with reference CVE BOP-2026-3859.

The sanction is adopted pursuant to Law 7/2022, of April 8, on waste and contaminated soils for a circular economy (LRYSC), which classifies the facts as a minor infringement in its Article 108.4, paragraphs b), c) and d), and sets the fine in accordance with Article 109.1(c). Completing the regulatory framework are the Municipal Ordinance for the Collection of Municipal Solid Waste and Street Cleaning (BOP of January 22, 2009, No. 14) and Law 16/2015, of April 23, on environmental protection of the Autonomous Community of Extremadura.

A case processed in five months

The procedure was opened following the report of the chief of the Local Police of March 9, 2026, which documented the dumping located in the vicinity of the Clean Point. The processing included:

• Order from the mayor and report from the Secretariat, both of March 10, 2026, and resolution initiating proceedings of March 17, 2026.
• Edictal notification of the initiation in the BOP of Cáceres No. 86, of May 8, 2026, since notifications at the known address were unsuccessful, in accordance with Article 44 of Law 39/2015 (LPACAP).
• Certificate of June 17, 2026 attesting that no submissions were made within the ten-business-day period, together with the proposed resolution of the investigating officer of the same date.
• New edictal notification of the proposal in the BOP of Cáceres No. 137, of July 21, 2026, and certificate of August 6, 2026 without submissions.
• Referral of the proceedings to the Mayor’s Office on August 10, 2026 for the final resolution.

Offender identified by the license plate

The resolution deems the dumping and deposit of sanitary ware outside the Clean Point to be proven based on the police report. The vehicle’s license plate allowed identifying Mr. Juan Carlos Hinojal Santos as owner and presumed responsible party, with DNI *9878, domiciled at Avenida de la Constitución, No. 24, Staircase 1, 3rd T, Cáceres. The conduct is classified as minor due to its slight amount or significance and for contravening local ordinances in the delivery of non-hazardous household waste.

The imposed sanction is a fine of 1,000 euros, in application of Article 109.1(c) of the LRYSC.

Payment in the voluntary period and appeals

Payment must be made within the voluntary period in accordance with Article 62.2 of Law 58/2003, of December 17, General Tax Law:

• If the notification arrives between the 1st and 15th of a month, until the 20th of the following month (or the next business day).
• If it arrives between the 16th and the last day, until the 5th of the second following month (or the next business day).

Against the resolution, which ends the administrative route, the interested party may file an optional reconsideration appeal with the Mayor within one month, or an administrative contentious appeal within two months before the competent Administrative Court.

A notice for users of the Clean Point

The publication of this resolution, also ordered under Article 44 of the LPACAP, makes the case an example of municipal control of illegal dumping: any deposit of waste outside the established channels, including the surroundings of clean points, may lead to proceedings and an economic sanction. For residents of Malpartida de Cáceres and the rest of the province, the announcement underscores the obligation to use collection services and authorized facilities, with the warning of fines that in the minor degree amount to 1,000 euros.
