Linares regulates parking spaces in new buildings

The Linares City Council has initially approved, by plenary agreement in an ordinary session on May 21, 2026, the modification of the current planning instrument to regulate parking spaces in building projects. The announcement is published in the Official Gazette of the Province of Jaén, number 166, dated August 27, 2026 (reference 2026/3917), and opens a twenty-day public information process.

The reform, promoted by the Mayor-President and signed by the Councilor-Delegate for Urban Planning and Environment, Antonio Garrido de Toro, updates articles 48 to 60 and 109 of the ordinances to establish minimum parking allocations for each class of use. It is processed in accordance with article 78.1 of Law 7/2021, of December 1, for the promotion of territorial sustainability in Andalusia, and article 104.1 of its General Regulation, approved by Decree 550/2022, of November 29.

Allocations for residential and tourist use

For housing, new multi-family buildings with more than five dwellings must reserve one space for every three dwellings or fraction thereof, decoupled from the building’s dwellings. For residential equipment use, elderly care centers with accommodation must have spaces for a minimum of 20% of the residential places, and other community accommodations, 10%.

For tourist accommodation, the following minimums are established:

Hotels and apartment-hotels with 4 stars: 20% of the accommodation units; 5 stars: 50%; lower categories, hostels, guesthouses, and shelters, no obligation.
Tourist apartments (Buildings/Complexes group) with 4 and 3 keys: 10% of the units; lower categories and the Sets group, no obligation.

Allocations for tertiary and community uses

The remaining uses are regulated by ratios of built surface area above ground:

Commercial: loading and unloading area of 25 m²; one space for every 150 m² if sales exceed 1,000 m²; and three spaces for every 100 m² in 1st and 2nd categories with more than 2,000 m².
Offices: one space for every 75 m².
Socio-cultural (more than 500 m²) and religious (more than 1,000 m²): one space for every 200 m².
Educational (1st grade): one space for every 100 m².
Healthcare (more than 500 m²): one space for every 50 m².
Care services (1st and 2nd grades): one space for every 100 m².
Industrial: one space for every 200 m²; in logistics and storage, one every 600 m².
Sports: 10% of the plot area destined for the use.
Open collective zone: one space per dwelling.

Exemptions and procedure

The regulation provides for exemptions in urban land when justified by the property structure, physical impossibility, or the protection status of the building, in renovations, rehabilitations, or restructurings of existing buildings. These exemptions may be reported by the Technical Commission for the Interpretation of Urban Planning and General Technical Regulations, following a request for a ruling prior to applying for a building permit or registering the responsible declaration.

During the twenty-day period, counted from the day following publication, the file may be examined at the City Council’s electronic office and at the Department of Environment and Territorial Planning, located at the Old Almería Station (C/ Úbeda, s/n), Monday to Friday from 9:00 to 13:30 hours.

The measure directly affects developers, builders, and residents of Linares, as it conditions new construction projects and renovations that involve a change of use. Until the final approval is resolved following the allegations process, interested parties may submit observations regarding the published text.
