Ledaña delegates the tendering of the water concession to the Mayor's office.

The Plenary of the Ledaña City Council, in extraordinary session held on August 7, 2026, agreed to delegate to the Mayor-Presidency all the powers corresponding to it as the contracting body of administrative contracting file No. 285/2026, relating to the concession of the drinking water supply and wastewater evacuation and treatment services of the municipality. The agreement is published in the Official Gazette of the Province of Cuenca number 92, of August 12, 2026 (NO. 1931, pp. 66-67), for general knowledge and in compliance with Article 51 of the Regulation on the organization, operation and legal regime of Local Entities.
The delegation is based on the second additional provision of Law 9/2017, of November 8, on Public Sector Contracts (LCSP), and includes all the powers necessary for the processing, award, formalization, execution, modification and termination of the contract. With it, the Mayor’s Office assumes from the preparation of the file to the full management of the future concession, which will set for decades the model and rates of the water service for the residents of Ledaña.
A complete catalogue of delegated powers
The agreement details the powers assumed by the contracting body, among which are:
- Request reports from the Office of Financial Evaluation of Castilla-La Mancha and the Central Contracting Board of the Administration of the Regional Government of Castilla-La Mancha.
- Approve the justification of the need for the contract, the preliminary design for the construction and operation of the works, the contracting file, and the sets of administrative clauses and technical specifications.
- Approve the expenditure and the economic and budgetary agreements, in accordance with Royal Legislative Decree 2/2004, of March 5, and the current or extended municipal budget.
- Convene the tender, order the publication of notices and appoint the Tender Committee.
- Decide on the admission or exclusion of bidders, classify the bids and award the contract, including the assessment of abnormally low bids in accordance with Article 149 of the LCSP.
- Formalize the contract, designate the contract manager and exercise the direction, supervision and control of its execution.
- Approve contractual modifications, impose penalties, agree on the extension, suspension or termination of the contract, as well as the acceptance of the works and the reversion of the assets attached to the concession.
- Resolve the return or cancellation of guarantees and hear appeals lodged against the file itself 285/2026.
Effects and publication of the agreement
The delegation agreement, adopted unanimously in Plenary, shall take effect from the day following its adoption, in accordance with article 9.3 of Law 40/2015, of 1 October, on the Legal Regime of the Public Sector. In addition to its insertion in the provincial bulletin, it will be published in the contracting profile and in the other legally appropriate media, so that the processing of the concession is now in the hands of the Mayor-President, María Clara Plaza Giménez.
Deadlines for appeal
Against the resolution, which ends the administrative route, interested parties may alternatively file:
- Optional motion for reconsideration before the City Council itself, within one month from the day following the publication of the notice, in accordance with articles 123 and 124 of Law 39/2015, of 1 October, on the Common Administrative Procedure.
- Administrative contentious appeal before the Administrative Court of Cuenca, within two months, according to article 46 of Law 29/1998, of 13 July, on Administrative Jurisdiction.
The concentration of contracting in the Mayor’s Office is a decisive step for Ledaña to expedite the tendering of an essential service for the municipality: the future concessionaire will not only manage the supply of drinking water and sanitation, but will also determine the rates that residents will pay throughout the entire term of the contract.
