Labastida provisionally approves the tourist stay tax and opens the period for allegations

The City Council of Labastida provisionally approved the municipal tax ordinance regulating the Tourist Stay Tax, in an ordinary plenary session held on September 14, 2026. The agreement is published in the Official Gazette of the Historical Territory of Álava (BOTHA) number 109, corresponding to Wednesday, September 23, 2026, within section II, Local Administration of the Historical Territory of Álava, with the official reference 2026-02674. The publication opens a thirty-day public information period for interested parties to examine the file and submit allegations.

The processing complies with the provisions of Article 19 of the Foral Normative Decree 1/2021, of January 29, which approves the Recast Text of the Foral Norm regulating Local Treasuries. The announcement details that the file remains available to any interested party during this period, both in municipal offices and electronically, and that allegations must be formulated within the established timeframe.

Deadline, consultation, and effects of the agreement

  • The public information period is thirty days, counted from the day following the insertion of the announcement in the BOTHA.

The agreement bears the signature of the Mayor-President, Daniel García Ruíz, and is dated in Labastida on September 15, 2026.

An expanding fiscal figure in the region

Labastida’s initiative joins a series of similar files processed this year by other Álava municipalities, which have been incorporating the same tax into their fiscal ordinances:

  • Elciego, whose Plenary provisionally approved the establishment and the tax ordinance on July 31, 2026.
  • Navaridas, which agreed to the initial approval in an ordinary session on August 25, 2026.
  • Leza, which initially approved its ordinance in an ordinary session on September 3, 2026.

In all three cases, the procedure is identical to that of Labastida: thirty days of public information from the day following the publication in the BOTHA and automatic conversion of the provisional agreement into a definitive one if no claims or observations are submitted.

Process open to the citizenry

The announcement serves to publicize the file and to enable the participation of those who may be affected by the new tax figure. The publication in the BOTHA therefore marks the effective start of the time limit and the moment from which any interested party may appear in the proceedings.

The approval of a tourist stay tax in Labastida directly affects the accommodation activity of the town and the visitors who stay overnight there, in a municipality with significant tourism weight within Rioja Alavesa. The allegations period is the last opportunity for the involved sectors and residents to influence the content of the ordinance before it is definitively established.
