La Rioja will reallocate credit released by waivers in municipal agricultural aid

Por FactBox Admin

La Rioja reasignará el crédito liberado por renuncias en ayudas agrarias municipales

The Government of La Rioja will allow the reallocation of credit that becomes available when a beneficiary waives agricultural infrastructure grants of a municipal nature, so that it can be allocated to applications that were denied due to a lack of budget. The measure is approved by Order AGM/48/2026, of September 25, published in the Official Gazette of La Rioja number 187, of September 29, 2026 (reference BOR-A-20260929-I–81), and sets a non-extendable deadline of 10 days for affected applicants to accept the new proposal.

The regulation modifies Order AGM/34/2024, of May 14 (Official Gazette of La Rioja number 96, of May 17, 2024), which regulates these subsidies within the framework of the CAP Strategic Plan 2023-2027 and Regulation (EU) 2021/2115. The granting is carried out under a competitive bidding process and following a public call, in accordance with Decree 14/2006, of February 16, and the General Subsidies Law 38/2003, of November 7.

The change is supported by article 63.3 of Royal Decree 887/2006, of July 21, given the possibility that some beneficiary may waive the subsidy. Management corresponds to the Directorate General for Rural Development, under the Ministry of Agriculture, Livestock, Rural World and Environment, whose head, Noemí Manzanos Martínez, signed the order in Logroño on September 25, 2026.

What changes in the regulatory bases

  • Section 3 of article 12 is modified: the resolution must include an ordered list of all applications that, while meeting the administrative and technical conditions, were not approved because they exceeded the maximum amount of credit set in the call, indicating the score obtained.
  • A section 5 is added to article 12: if an applicant waives before the publication of the granting resolution and this releases sufficient credit, the managing center may notify those rejected due to lack of credit to state whether they accept the subsidy.
  • The deadline to respond is 10 non-extendable days.
  • The new granting resolution will be published in the Official Gazette of La Rioja.

Validity and procedure

The order enters into force the day following its publication, but its effects are retroactive to the applications submitted in the last approved call currently being processed. The procedure is resolved and published within 6 months of its start; once this period has elapsed without an express resolution, the application is understood to be rejected in accordance with article 25.5 of Decree 14/2006.

The current call

The latest call is the second of 2025, approved by Resolution 1682/2025, with a maximum budget availability limit of 1,500,000 euros charged to the 2027 financial year and an initial distribution of 80% for roads and 20% for other infrastructures. 57 applications were submitted: 54 corresponding to municipal roads and 3 to other infrastructures.

Resolution 332/2026, from the Directorate General for Rural Development, published in the Official Gazette of La Rioja number 155, dated August 14, 2026 (reference BOR-A-20260814-III–3193), resolved the granting of a total amount to be committed of 1,484,322.68 euros: 1,438,836.28 euros for roads and 45,486.40 euros for other infrastructures. The grants can be co-financed with 45% from the European Agricultural Fund for Rural Development (EAFRD), 9% from the Ministry of Agriculture, and 46% from the Regional Ministry.

During the processing, an appeal from the City Council of Villar de Arnedo (file CAM-26-0055) was accepted, which increased its eligible investment to 24,387.75 euros.

The modification provides room for city councils and local entities that were left out of the budget by a narrow margin of points, as the credit released by waivers can reach them without waiting for a new call. The change already applies to the call currently being processed, so councils with applications rejected due to lack of credit must stay alert to communications from the management center and respond within a period of 10 days.
