La Rioja sets minimum services for the teachers' strike on September 24 and 25

The Official Gazette of La Rioja publishes this Tuesday, September 22, 2026, Resolution 2235/2026, from the Department of Finance, Public Governance, Digital Society and Government Spokesperson, which approves the minimum services during the general strike called by the National Independent Union for Development and Innovation (SINDI-K) for September 24 and 25. The regulation affects all teaching staff providing services in public non-university education centers in the community and is published under the official reference BOR-A-20260922-III–3613.

Who is calling the strike and who is affected

The call was formalized on September 14, 2026, through the notice provided for in RDL 17/77, submitted to the Ministry of Labor and Social Economy and forwarded to the Department of Economy, Innovation, Business and Self-Employment and the Department of Education and Employment of La Rioja. The territorial scope of the strike is the entire Spanish State.

The subjective scope covers all teaching staff in public centers, regardless of their employment status:

• Career civil servants, trainees, and interim staff.
• Contractual teaching staff.
• Early Childhood, Primary, Compulsory Secondary, Baccalaureate, and Vocational Training Education.
• Special Regime Education, Adult Education, guidance teams, and other educational services.

The strike will begin at 00:00 hours on September 24 and end at 24:00 hours on September 25, 2026, encompassing the entirety of the working day, both teaching and non-teaching hours, including afternoon and night shifts in centers that have them.

Legal basis and agreement with the strike committee

The resolution invokes Article 28.2 of the Spanish Constitution, which allows for the limitation of the right to strike to ensure the maintenance of essential community services. The authority to approve these measures corresponds to the Governing Council of La Rioja according to Article 14.2.o) of Law 9/2023, of May 5, on the public service of the Autonomous Community of La Rioja.

This authority was delegated to the regional ministers by the Agreement of the Governing Council of December 3, 2024, published in the Official Gazette of La Rioja on December 4, 2024. The text emphasizes that, once the strike committee was summoned, an agreement was reached for the establishment of minimum services. The resolution was signed in Logroño on September 18, 2026, by Minister Alfonso Domínguez Simón.

Minimums by type of center

The annex details the required staffing during the two days of the strike:

• Early Childhood and Primary Education Centers: the director or a member of the management team acting as a substitute, one teacher for every 60 Primary students or fraction thereof, and one for every 30 Early Childhood students or fraction thereof, ensuring a minimum of two teachers per building.
• Grouped Rural Schools: in the main centers, the director or their substitute; in the remaining locations, the same ratios as in Early Childhood and Primary education.
• Secondary Education Institutes, Conservatories, Official Language Schools, Adult Centers, and the Higher School of Design: the director or a member of the management team, one teacher per independent building, and one per compulsory secondary education (ESO) section.
• Educational Guidance Teams, Early Intervention Teams, and the Riojan Center for Educational Innovation: the director or a civil servant acting as a substitute.
• Centers with students with special educational needs: in addition to the above, one Therapeutic Pedagogy teacher.
• Regional Government First-Cycle Nursery Schools: the director.

The resolution guarantees the opening of the centers and basic care for students during the two days of the strike, so that Riojan families will have school coverage despite the stoppage. The agreement reached with the strike committee avoids legal conflict over minimum services and sets specific ratios that management teams must apply in each center.
