La Puebla del Río modifies and reopens the Local Police recruitment guidelines
Por FactBox Admin

The Mayor’s Office of La Puebla del Río has upheld the appeal for reversal filed by an applicant and has modified the rules of the call for four Local Police positions, suspending the selection process and opening a new application period. The decision is formalized in Mayoral Resolution No. 1119/2026, of October 6, published in the Official Gazette of the Province of Seville No. 196, of October 8, 2026 (reference BOP-SE-2026-196021).
Context: four positions and incomplete rules
The resolution, signed by Mayor María Dolores Prósper Pérez, upholds the appeal for reversal filed on September 25, 2026 (RE No. 4580) by Mr. Jesús Molina Castilla against Mayoral Resolution No. 960/2026, of August 31, which approved the regulatory rules of the call.
The rules regulated the selection, as career civil servants, through the competitive examination and open entry system, of four Local Police positions for the City Council of La Puebla del Río, belonging to the Special Administration Scale, Special Services Sub-scale, Police category. They were published in full in the Official Gazette of the Province of Seville No. 171, of September 3, 2026, and their announcement appeared in the Official Gazette of the Junta de Andalucía No. 181, of September 17, 2026, and in the Official State Gazette No. 236, of September 24, 2026, the latter publication of which opened an application submission period of twenty business days.
The legal report detects an omitted requirement
The legal report from the Social Graduate, dated October 6, 2026, concludes that the rules did not incorporate the participation requirement provided for in Article 18.1.h) of Decree 8/2026, of January 28, the implementing regulation of Law 6/2023, of July 7, on Local Police of Andalusia.
This provision requires proof, in the event of having previously obtained a position through open entry, of having served in the municipality where it was obtained for at least five years; if several positions have been obtained, the five years are computed from the last one. The report emphasizes that the municipal authority to approve the rules does not allow for the setting of access conditions different from those required by regional regulations, and warns that the omission affects the principles of equality, merit, capacity, publicity, and free competition.
Modification of the rules and suspension of the process
The resolution agrees to modify Rule 3, regarding the requirements for applicants, incorporating a new section k) with said requirement, and adds a new section h) to Rule 10.1, regarding the submission of documents. The remainder of the content of the rules remains in the same terms.
Furthermore, the development of the selection process is suspended: the City Council is obliged, from the date of the resolution, to refrain from taking further steps forward, and the suspension of the application submission period is agreed upon, the effectiveness of which toward the interested parties shall occur from the publication in the Official Gazette of the Province of Seville.
New period of twenty business days and preservation of applications
A new period of twenty business days is opened for the submission of applications, which will begin to count from the day following the publication of the new call for applications announcement in the Official State Gazette. Applications already submitted shall remain valid and do not need to be resubmitted, although their authors must meet all the requirements of the modified rules before the new period expires.
Once that period has closed, the processing will continue with the approval of the provisional list of admitted and excluded persons, in accordance with the modified rules and Article 7 of Decree 8/2026. The modified rules will be published in full in the Official Gazette of the Province of Seville, and the announcement of the modified call for applications will be disseminated in the Official Gazette of the Junta de Andalucía and in the Official State Gazette.
Appeals and scope of the decision
Against the resolution, which ends the administrative route, an optional appeal for reversal may be filed within one month before the Ms. Mayor, or a contentious-administrative appeal may be filed within two months before the Contentious-Administrative Section of the Court of First Instance of Seville.
The decision de facto reopens the selection process and obliges applicants to verify their compliance with the new residency requirement, with a direct impact on who will be able to compete for the four announced positions.
