The Board sets the crop plan for the replacement farms in Alfoz de Quintanadueñas

The Regional Government of Castilla y León, through the Territorial Service of Agriculture, Livestock, and Rural Development of the Territorial Delegation of Burgos, has established the Crop and Utilization Plan for the new replacement plots resulting from the boundary marking in the land consolidation area of Alfoz de Quintanadueñas –second sector– Marmellar de Arriba (Burgos). The regulation is published in the Official Gazette of the Province of Burgos number 168, dated September 4, 2026, with reference BOPBUR-2026-03680, and was signed in Burgos on August 24, 2026.

The plan is issued under article 20 of the Land Consolidation Law of Castilla y León, of November 28, 1990, applicable by the first transitional provision of Law 1/2014, of March 19, Agrarian Law of Castilla y León. The document regulates when and how the new owners of the replacement plots may cultivate and utilize the parcels, as well as the rights of the former owners over pending crops.

Crop Transfer Calendar

The plan establishes differentiated deadlines according to the type of crop sown in the 2025-2026 agricultural campaign:

  • Cereals, protein crops, potatoes, and legumes, as well as plots without work until the resurvey: new owners will cultivate starting from the removal of the harvest and, in any case, from October 1, 2026 (or the date of taking possession if later).
  • Oilseeds and vegetables: transfer starting from the removal of the harvest and, in any case, from January 1, 2027 (or the date of taking possession if later).
  • Vineyards, fruit trees, walnut trees, and timber trees: utilization by the former owners is extended until December 31, 2026, passing to the new owners on January 1, 2027, or the day following the taking of possession.

Obligations and Sanctions Regime

Former owners who choose to cut down trees must remove the stumps, fill the hole, and clear them, with prior authorization from the Territorial Environmental Service. The cleaning and preparation of the future plot before taking possession may only be carried out with the consent of the current owner and following the instructions of said service, depositing the material within the plot itself and never in plots, wasteland, or common lands allocated to third parties.

Non-compliance with the plan is classified as a minor infringement under article 201.1.d) of Law 1/2014, punishable by a warning or a fine of up to 1,000 euros, in accordance with article 202.1.a) of the same legal text. Local authorities will monitor compliance and report infringements, and interested owners may report those who commit them.

Doubts regarding the interpretation of these regulations may be resolved at the Agricultural Structures Area of the Territorial Service, located on the 4th floor of the Territorial Delegation of Burgos, plaza de Bilbao, number 3. The document is signed, on behalf of the head of the territorial service, by the technical secretary Encarna Peña Marcos.

The publication provides legal certainty to the farmers of the area at a key moment of land consolidation, organizing the transition of the plots and avoiding conflicts over pending harvests. Knowing the deadlines and obligations is essential for the affected holders, who are subject to financial penalties if they fail to comply with the transfer schedule.
