La Junta ejecutará subsidiariamente la erradicación de Xylella en 155 parcelas

The Regional Government of Extremadura (Junta de Extremadura) will subsidiarily execute the phytosanitary measures for the eradication of Xylella fastidiosa (Wells et al.), subspecies fastidiosa, in infected plots across six municipalities in the province of Cáceres. This is established by the Resolution of September 28, 2026, from the Directorate General of Agriculture and Livestock, the full content of which is published via a brief indication in the Official Gazette of Extremadura (DOE) number 194, of October 7, 2026 (reference 2026081645).

The Announcement of September 29, 2026, signed by the Head of the Plant Health Service, Guadalupe Espárrago Rodilla, specifies that the competent body determined that notification by means of announcements or the publication of the act could prejudice legitimate rights or interests; therefore, it proceeds in accordance with the provisions of Article 46 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Subsidiary execution and competence

The resolution establishes the subsidiary execution of phytosanitary eradication measures in certain infected areas of the Autonomous Community of Extremadura. The interested parties are the owners of the plots listed in the annex, who shall bear the costs of the actions that the Administration executes on their behalf.

The Directorate General of Agriculture and Livestock acts within the framework of the competencies attributed to it by Decree 110/2026, of May 26, which establishes the organic structure of the Ministry of Agriculture, Livestock and Natural Environment, whose Article 3.1 entrusts it with functions relating to the management of agricultural production.

Affected plots

The annex contains the SIGPAC list of affected plots, with 155 enclosures distributed among six municipalities, all in the province of Cáceres:

  • Hoyos: 69 enclosures in polygons 7, 10, 11, and 12.
  • Villamiel: 18 enclosures in polygons 5, 6, 7, and 25.
  • San Martín de Trevejo: 29 enclosures in polygons 3, 4, 5, and 8.
  • Perales del Puerto: 17 enclosures in polygons 14 and 15.
  • Valencia de Alcántara: 17 enclosures in polygons 39, 54, and 55.
  • Valverde del Fresno: 5 enclosures in polygons 6 and 7.

Each enclosure is identified by a point code from the EX0xxxx/Xf series, followed by province, municipality, polygon, plot, and enclosure.

Deadlines, appeals, and access to the file

The resolution does not exhaust administrative remedies; therefore, an administrative appeal (recurso de alzada) may be filed against it within one month from the day following its announcement in the DOE. The appeal may be submitted to the Directorate General of Agriculture and Livestock or to the head of the Department of Agriculture, Livestock and Natural Environment, in accordance with articles 121 and 122 of Law 39/2015 and article 101 of Law 1/2002, of February 28, of the Government and Administration of the Autonomous Community of Extremadura.

Within the same one-month period, interested parties may access the full content of the administrative file:

  • From Monday to Friday, between 10:00 and 14:00 hours.
  • At the offices of the Plant Health Service of the Department of Agriculture, Livestock and Natural Environment.
  • Location: avenida Luis Ramallo, s/n, Mérida.

The measure directly affects the owners of the indicated plots, who will see actions executed by the Administration the costs of which will be charged to them, and the agricultural sector of the region as a whole, exposed to the restrictions derived from the control of a bacterium considered to be under quarantine. Publication in the DOE replaces individual notification and immediately activates the deadlines to challenge or appear in the proceedings.
