The Junta executes the sentence convicting it for the Las Hurdes fire

The Regional Ministry of Industry, Energy, Science and Territory of the Regional Government of Extremadura has ordered the execution of judgment no. 60/2026, dated May 14, which condemns the Administration to pay 14,719.76 euros plus legal interest to the company Excavaciones y Transportes El Guerra, SL. The order is formalized through a resolution of the General Secretariat dated August 10, 2026, published in the Official Gazette of Extremadura number 161, dated August 20, 2026 (reference 2026062159).

The ruling, issued by the Court of First Instance, Contentious-Administrative Section, Plaza no. 1 of Cáceres, in summary proceeding no. 47/2026, upholds the company’s appeal against the dismissal by administrative silence of its claim for late payment interest. The judgment has become final as the legal period elapsed without any appeal being filed.

Origin of the dispute

The claim arises from the delay in payment of invoice no. A-409, corresponding to the contract for “Emergency works to mitigate the effects of the Las Hurdes forest fire in July 2022 (Lot 5: Construction of auxiliary infrastructures to undertake restoration works)”. The company claimed the late payment interest derived from that non-payment, which the Administration did not address through administrative channels, prompting the contentious appeal.

The ruling condemns the defendant Administration to pay the appellant the amount of 14,719.76 euros, with legal interest from the date of the administrative claim, and with the express imposition of costs, although limited to 300 euros for all concepts, VAT included.

The execution is based on Article 40.1 of Decree 1/2022, of January 12, which approves the Regulation of Organization and Operation of the General Advocacy of the Regional Government of Extremadura, which assigns the material execution of final judgments to the body competent by reason of the subject matter. Articles 8 and 9 of Decree 59/1991, of July 23, which regulates the administrative processing in the execution of judicial resolutions, and Articles 103 et seq. of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, are also applied.

The resolution is issued in exercise of the powers delegated by the Regional Minister through the resolution of May 8, 2026, and in accordance with the organic structure established by Decree 107/2026, of May 26. The signature corresponds to the General Secretary, María de la Concepción Montero Gómez.

Body in charge of executing the ruling

The resolution orders the General Directorate for Sustainable Management and Forestry Policy, as the competent body for material execution, to carry out the provisions of the ruling to its full and due effect. Once the ruling became final, the court forwarded the certified copy along with the administrative file to the body that issued the contested resolution, which was required to acknowledge receipt within ten days.
