The Board classifies the Deputy Intervention office of Cártama as a reserved position

The General Secretariat of Local Administration, under the Ministry of Tourism, Justice, Deregulation and Local Administration of the Regional Government of Andalusia (Junta de Andalucía), has classified the job position designated as Deputy Comptroller, class 2nd-27111 of the City Council of Cártama (Málaga) as reserved for Local Administration officials with national qualification. The decision is detailed in the Resolution of September 2, 2026, published in the Official Gazette of the Regional Government of Andalusia (BOJA) number 173, dated September 7, 2026, page 11562/1, with file number 0167/2026.

The classification is processed at the request of the Málaga city council itself, which requested that the position be reserved for officials with national qualification. The procedure has been conducted in accordance with Royal Decree 128/2018, of March 16, which regulates the legal regime of these officials, and with the powers conferred in section 7 of article 92 bis of Law 7/1985, of April 2, regulating the bases of the Local Regime, as well as in article 7.1.h) of Decree 191/2026, of July 30, which establishes the organic structure of the ministry.

Characteristics of the classified position

The Deputy Comptroller position is assigned to the subscale and category of Comptrollership-Treasury, entry, with a destination supplement level of 29. Its technical data are as follows:

• Designation: Deputy Comptroller, class 2nd-27111.
• Assignment: Group A, Subgroup A1.
• Subscale and category: Comptrollership-Treasury, entry.
• Level: 29.
• Provision system: Competition.

The resolution provides that the filling of the position will be carried out through a competition system, as stated in the request from the local entity.

Effects and coverage period

The resolution shall take effect from the day following its publication in the BOJA. However, the reserved functions may continue to be performed, where applicable, according to the situation prior to this resolution for a maximum period of three months, until the position is filled in accordance with any of the provision systems provided for in Royal Decree 128/2018, of March 16.

The resolution is signed by the General Secretary, Cristina Alejandra Jiménez Jiménez, dated September 2, 2026, in Seville.

Appeals process

Against the resolution, which ends the administrative route, interested parties may file the following appeals:

• Contentious-administrative appeal before the judicial bodies of this order, in the form and within the time limits provided for by Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
• Optional appeal for reversal (recurso potestativo de reposición) before the same body that issued the act, within one month from the day following its publication, in accordance with articles 123 and 124 of Law 39/2015, of October 1.
• Optional request provided for in article 44 of Law 29/1998, within two months, when the challenge is made by a Public Administration.

The classification reinforces the economic-financial control of the Cártama City Council, by guaranteeing that the Vice-Comptrollership is carried out by a civil servant with national qualification, with the guarantees of suitability and statutory regime required by local government regulations. For the residents of the Malaga municipality, the measure ensures the professionalization of budgetary and treasury management, a key element for the transparency and sustainability of local accounts.
