The Guard of Jaén delegates the Mayoralty to its first deputy

The City Council of La Guardia de Jaén has made public the temporary delegation of all Mayoral functions to the first deputy mayor, thereby guaranteeing the continuity of the municipal government during the mayor’s absence. The decision, adopted by Mayoral Resolution No. 2026-0695, dated August 20, 2026, was published in the Official Gazette of the Province of Jaén, number 172, dated September 4, 2026, on page 13295.

Scope of the delegation

The resolution, signed by the mayor-president Juan Morillo García, delegates to José Miguel Jiménez López, first deputy mayor, all the functions corresponding to the office of the mayor. The delegation covers the days from August 20 to 22, 2026, both inclusive, a period of three working days during which the deputy mayor will fully assume the competencies of the Mayor’s Office.

Legal framework and appeals

The delegation is framed within the organization and operation regime of local entities, which allows the mayor to delegate their powers to members of the corporation to ensure ordinary management in their absence. Against the resolution, which exhausts administrative remedies, interested parties may file an optional appeal for reversal (recurso de reposición) before the Mayor’s Office itself within one month from the day following the publication of the announcement, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Alternatively, a contentious-administrative appeal may be filed directly before the Contentious-Administrative Court of Jaén within two months, in accordance with article 46 of Law 29/1998, of July 13, of the Contentious-Administrative Jurisdiction. If the appeal for reversal is chosen, the contentious route cannot be pursued until the former is expressly resolved or dismissed by administrative silence.
