La Guancha and Güímar approve their vacation rental control plans

The city councils of La Guancha and Güímar have approved their respective verification and control plans for vacation homes, an internal planning instrument that Law 6/2025, of December 10, on the Sustainable Management of the Tourist Use of Housing requires all Canarian municipalities to design. Both agreements are published in the Official Gazette of the Province of Santa Cruz de Tenerife, number 99, of August 19, 2026, and directly affect the vacation rental sector on the island.

In La Guancha, the Corporate Plenary unanimously approved the plan in an ordinary session held on July 30, 2026, according to the announcement with reference 1724870 (p. 23536). In Güímar, the approval was formalized through Mayoral Decree No. 3134/2026, of August 10, 2026, recorded in the announcement with reference 1724113 (p. 23545).

Law 6/2025, in effect since December 13, 2025, subjects the tourist use of housing for accommodation to the regime of classified activities provided for in Law 7/2011, of April 5, and its implementing regulations. Its second additional provision imposes on city councils the obligation to design and implement, within a maximum period of eight months from its entry into force, a municipal verification and control plan for all vacation homes regarding classified activities.

The plan must be based on the detailed list of vacation homes registered prior to the law’s entry into force, sent to each city council by the Department competent in Tourism matters of the Government of the Canary Islands. Its duration cannot exceed four years and must include selective inspection actions on homes that show signs of risk or irregularities.

The La Guancha plan

The La Guancha plan, signed by the mayor-president Alejandro Herrera Luis, has a validity of four years and is structured into four phases:

  • First Phase (control): analysis of the list of registered homes and creation of the “Registry of operational vacation homes in the municipality,” verifying whether the activities are in operation.
  • Second Phase (examination of prior communications): verification of data, facilities, and activity, with a period of 18 months to report on communications submitted before the plan’s entry into force.
  • Third Phase (verification): initial in-person verification, with a report concluding in a favorable pronouncement, unfavorable due to correctable defects, or unfavorable due to serious defects; it must be completed within three years.
  • Fourth Phase (inspection): preparation of a list of homes to be inspected for signs of risk or irregularities, which takes place during the fourth year of validity.

The plan pursues a purpose of legality (verifying compliance with formal and technical requirements) and another of planning (serving as a prior diagnosis for future municipal urban planning instruments). Homes registered with the Government of the Canary Islands, communicated to the city council, and in operation will be placed in a state of formal legality, a step that must be achieved within a period of six months.

The Güímar plan

In Güímar, the plan was approved by the mayor through Decree No. 3134/2026, and the announcement appears signed by the first deputy mayor, David Román Escobar, on August 13, 2026. The instrument covers all existing vacation homes in the municipal district regarding classified activities, under the same terms required by Law 6/2025.

Impact on the sector

The entry into force of these plans represents a reinforcement of administrative control over vacation rentals in Tenerife, with physical inspections, verification of technical requirements, and a municipal registry that will distinguish homes in a state of formal legality from those operating without prior communication. Owners of vacation homes must provide documentation such as civil liability insurance and complaint forms, and activities that do not regularize their situation may be excluded from the registry or declared illegal.
