La Batllia aprova l'estat de crèdits de la fallida de Construccions Loan

The Court of Andorra has definitively approved the statement of claims for the insolvency and bankruptcy of the company Construccions Loan, SA, as well as the personal extension of the bankruptcy to Josep Maria Loan Fité. The resolution was adopted by the Court of Batlles on May 29, 2026, and is made public via an edict dated October 1, 2026, published in the Official Bulletin of the Principality of Andorra (no. 116, of October 14, 2026), in section 14, Administration of Justice.

The official text specifies that the statement of claims was submitted by the judicial administrator of the insolvency proceedings through a writing dated January 23, 2026. The edict is signed by Blanca Gómez de Urrutia de Antón, judicial secretary of the Court of Andorra, and is published for general knowledge so that any creditor or interested party may be aware of it.

Definitive approval of the statement of claims

The agreement of the Court of Batlles closes the phase of determining the claims of the insolvency proceeding. The operative part of the resolution establishes:

  • To definitively approve the statement of claims for the insolvency and bankruptcy of Construccions Loan, SA.
  • To approve the personal extension of the bankruptcy to Josep Maria Loan Fité.
  • To accept the statement of claims submitted by the judicial administrator, via the writing dated January 23, 2026.
  • To notify the judicial resolution to the interested parties.

The edict does not detail the total amount of the recognized claims nor the number of creditors affected by the proceeding.

Personal notification and appeal process

Parallelly, the Court has published a second edict, also dated October 1, 2026, addressed specifically to Josep Maria Loan Fité for the purposes of personal notification of the court order. This second announcement reproduces the operative part of the resolution in full and reminds that the decision is not final.

An appeal may be filed against the resolution before the Civil Chamber of the High Court of Justice, in accordance with article 342 of Law 24/2018, of October 18, of the Code of Civil Procedure.

Deadlines and appeal requirements

The procedural requirements set by the edict are as follows:

  • Deadline: thirteen business days counted from the day the resolution is notified.
  • Form: a written document in which the grounds for the appeal must be stated.
  • Documentation: a copy of the resolution subject to appeal with the notification date must be attached.
  • Legal basis: articles 334.1 and 3 of Law 24/2018, of October 18, of the Code of Civil Procedure.

The second edict is published precisely for the purpose of notifying Josep Maria Loan Fité, as indicated in the official text itself.

Impact for creditors and the sector

The news directly affects the creditors of Construccions Loan, SA and anyone who maintains pending contractual relationships with it, who now have a definitive statement of credits and a limited deadline to challenge it. The extension of the bankruptcy to Josep Maria Loan Fité incorporates him into the proceedings, a relevant point for those who must claim amounts. For the Andorran construction sector, this case adds to other insolvency proceedings published in recent months by the same court secretary and reinforces the convenience of verifying the solvency of contractors before committing to work.
