The Mayor's Office of Petrer assumes jurisdiction over the police management platform contract
Por FactBox Admin

The Mayor’s Office of the Petrer City Council has assumed the competence to process the contract for the supply, implementation, and maintenance of a comprehensive police management platform, its associated mobile applications, and the portable printing equipment destined for the Local Police. The decision was adopted via Mayoral Resolution No. 2026-3202, of October 16, 2026, and is published as an announcement in the Official Gazette of the Province of Alicante No. 202, of October 23, 2026, section III. Local Administration, with reference 8041/2026.
What changes in the processing of the file
The assumption of competence is specific and affects only procurement file No. 8671/2024-C16/26. Until now, the competence regarding procurement corresponded to the Local Government Board by delegation from the Mayor’s Office, with the exception of matters reserved for the Plenary.
With this resolution, the body directing the procedure ceases to be the Government Board and becomes the Mayor’s Office, without the measure extending to any other municipal contract. The announcement expressly emphasizes this singular nature: the assumption of competence is limited to the cited file “and solely regarding the same.”
The framework of the delegation that is now excepted is Mayoral Resolution No. 2152/2023, of June 21, 2023, which assigned the knowledge of non-plenary procurement matters to the Local Government Board.
A supply, implementation, and maintenance contract
The object of file 8671/2024-C16/26 comprises three distinct services contracted jointly:
- Supply of a comprehensive police management platform.
- Implementation of said platform and its associated mobile applications.
- Subsequent maintenance of the system.
- Portable printing equipment to provide for the Local Police of the Petrer City Council.
The announcement does not detail the amount, execution period, or number of lots; therefore, the economic information of the contract does not appear in this publication.
Legal basis and precedents of the same body
The publication is supported by Article 10 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, and by Articles 44 and 116 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2,868/1986, of November 28.
This is not a new formula in the council. In the same fiscal year, the Petrer City Council had already published specific assumptions of competence with an identical structure: resolutions 2026-2529 and 2026-2530, both of August 13, 2026, disseminated in the Official Gazette of the Province of Alicante No. 160, of August 25, 2026, referring to the redevelopment of the surroundings of Galicia Street and the rehabilitation of the buildings on Madrid Avenue.
Deadlines and channels for appeal
The act is final in administrative proceedings and may be appealed through alternative means:
- Optional appeal for reversal (recurso de reposición) before the same body that issued it, within one month from the day following the receipt of the notification, in accordance with Articles 123 and 124 of Law 39/2015, of October 1; it is considered dismissed if there is no express resolution within one month.
- Contentious-administrative appeal before the Contentious-Administrative Court of Alicante, within two months from the day following the notification of the act or the express resolution of the appeal for reversal, or six months if the latter is considered dismissed by silence.
- If an appeal for reversal is filed, the contentious-administrative route cannot be pursued until it is expressly resolved or a presumed dismissal occurs.
The announcement is signed by the mayor and is published “for general knowledge,” although the text does not include the name of the office holder.
The move is significant for bidders interested in a police digitalization contract and, above all, for the control of local spending: it concentrates in the Mayor’s Office the decision on a file that until now had to pass through the Local Government Board, such that the body that resolves the award and the one politically responsible for the contract become the same. For companies in the sector, the next milestone to follow is the publication of the tender and the specifications on the procurement platform, which is not yet listed in this bulletin.
