La Adrada approves the fee for vehicle entry via sidewalks

The City Council of La Adrada has approved the Fiscal Ordinance Regulating the Tax for Vehicle Entry via Sidewalks and Public Road Reservations for Parking, Loading and Unloading of Goods of any Kind, which taxes the use of public roads for vehicle access. The regulation, signed by Mayor María del Pilar Martínez Saguar on June 25, 2026, is published in the Official Gazette of the Province of Ávila number 160, dated August 20, 2026, under file number 1691/26.

The ordinance is issued in exercise of the powers conferred by articles 133.2 and 142 of the Constitution and article 106 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, in accordance with article 20 and articles 15 to 19 of Royal Legislative Decree 2/2004, of March 5, Law Regulating Local Treasuries. Persons or entities in whose favor the licenses are granted, or those who benefit from the use if it was carried out without the timely authorization, are obliged to pay.

Rates and Amounts

The tax is structured into three rates, all with an annual fee of 100.00 euros, which are settled for each requested or carried out use and are irreducible for the natural time periods indicated in each section:

• First rate: entry of vehicles into private buildings or garages, 100.00 € annually.
• Second rate: entry into premises for the sale, exhibition, or repair of vehicles, or for the provision of greasing, washing, fueling services, etc., 100.00 € annually.
• Third rate: entry of vehicles into homeowners’ associations, with a basic amount of 100.00 € plus 20.00 € per garage space.

These fees apply to entrances or passages up to 3 meters wide. For the excess over 3 meters, a surcharge of 25% per linear meter or fraction will be paid on the basic fee. For the purposes of applying the rate, the public roads of the municipality are classified into a single category.

Management and Payment Obligation

Interested parties must previously request the license, make the prior deposit, and submit a declaration accompanied by a detailed plan of the use and its location within the municipality. The municipal technical services will check the declarations and verify the urban planning feasibility before granting the authorization; in case of denial, interested parties may request the refund of the amount paid.

The payment obligation arises, for new uses, at the time the license is requested, and for those already authorized and extended, on the first day of each calendar year. Payment is made via direct deposit at the Municipal Depositary before withdrawing the license, or, in the case of extended uses, once included in the tax registers or rolls at the Municipal Collection offices.

Non-compliance and entry into force

In the event of non-payment, the City Council will request payment through formal notification, granting a period of 15 calendar days for voluntary payment plus legal surcharges. Once this period has elapsed without payment being made, enforcement proceedings will be initiated in accordance with Local Treasury regulations, and the City Council may revoke the license and order the immediate removal of the vehicle crossing or the closure of the access at the expense of the obligated party, with subsidiary execution by municipal services if not voluntarily removed. As long as there is an outstanding debt, no new licenses or extensions will be granted to the same subject.

The ordinance shall enter into force and begin to be applied, in accordance with article 17.4 of Royal Legislative Decree 2/2004, from its full publication in the Official Gazette of the Province, remaining in force until its modification or repeal.

The new tax directly affects private garages, homeowners’ associations, and businesses in the municipality that use the public road for vehicle access, and reinforces municipal control over the public domain. Residents and establishments in La Adrada must regularize their accesses and pay the corresponding annual fee, with the width surcharge when the crossing exceeds three meters.
