Kontsumobide-Basque Consumer Institute has imposed a fine of 1,000 euros on the company Ediciones Directas Hogar, S.L., resolving a sanctioning procedure carried out in the field of consumption. The resolution was signed by director Ana María Sánchez Herráez on September 28 in Vitoria-Gasteiz, and was published in the BOPV No. 198 of October 16, 2026, with official reference 2026/4346. As personal notification to the company could not be achieved, it has been notified via public announcement.

Which rule was violated and which behavior was penalized

According to the resolution, the violated rule is Article 141.1 of the Ley 4/2023 de Estatuto de las Personas Consumidoras y Usuarias (Statute of Consumers and Users). This provision penalizes behaviors that obstruct the work of authorities with inspection powers in the field of consumption. Specifically, it includes three behaviors:

  • Refusing to facilitate inspection work or obstructing it.
  • Failing to provide data or information requested by the competent authorities or their agents.
  • Providing incorrect or incomplete information, as well as presenting false documentation.

In this case, Kontsumobide accuses the company of failing to cooperate in inspection work and providing incorrect data.

The 1,000 euro fine and payment deadlines

The resolution establishes the specific amount and obligations:

  • Amount of the fine: 1,000 euros.
  • File number: SAN-20A001-41-2026.
  • Tax identification number of the interested party: B75160721.
  • Fines notified between the 1st and 15th of the month: must be paid by the 5th of the following month from the date of notification.
  • Fines notified between the 16th and the end of the month: must be paid by the 20th of the following month from the date of notification.

Payment must be made in accordance with the provisions of paragraphs 1, 3, and 4 of Article 44 of Decreto 212/1998, de 31 de agosto —which approves the Payment Regulation of the General Treasury of the Basque Country—.

How to file an appeal and how to pay

The resolution does not exhaust administrative remedies, and the company has been notified of several options and obligations:

  • An appeal for reversal may be filed addressed to the Minister of Tourism, Commerce and Consumption.
  • Deadline for filing the appeal: one month starting from the day following the receipt of the notification.
  • When making the payment, the NIF B75160721 and file number SAN-20A001-41-2026 must be mentioned, and it must be indicated that the payment is for Kontsumobide-Basque Consumer Institute.
  • The file documents are available in the electronic office folder of the Basque Government.

Notification and institutional context

After unsuccessful attempts at personal notification, the announcement was published as ordered by Article 44 of Ley 39/2015, de 1 de octubre, so that it may serve as notification to the interested party. The publication will take effect from the day following its publication.

Kontsumobide-Basque Consumer Institute is an autonomous body of the Basque Government, with the authority to inspect, sanction, and protect consumer rights in the field of consumption. Its directorate resolves sanctioning proceedings in the area of consumption, and these decisions are published in the BOPV when personal notification cannot be made.

Conclusions

This resolution makes it clear that failing to cooperate in inspection work and providing incorrect data have economic consequences, even in procedures that may be common in the daily operations of companies. Consumer protection systems aim to protect the inspection powers of the authorities, and sanctions serve as a tool to guarantee that power. Companies and professionals must keep in mind that providing accurate and complete information is not an option, but an obligation.
