Juzgado autoriza la entrada en una vivienda de Osorio para el desahucio

The Administrative Litigation Court No. 3 of Cádiz has issued a decree authorizing entry into a residence in the capital of Cádiz at the request of the Housing and Rehabilitation Agency of Andalusia (AVRA), within the framework of an administrative eviction. The resolution is published in the Official Gazette of the Province of Cádiz No. 203, dated October 21, 2026, by means of an edict with announcement No. 342,289, due to the impossibility of notifying the occupants at the provided address. The affected property is located at calle Osorio No. 1, 1º, 11005 Cádiz.

The procedure and the processing body

The decree is issued in the home entry authorization procedure 217/2026, with N.I.G. 1101245320260000809, and the appealed action is an administrative eviction. The application was submitted by the court representative (procurador) Antonio Cervilla Puelles on behalf of the Housing and Rehabilitation Agency of Andalusia, assisted by the lawyer Juan Manuel Blanco Curtido.

The resolution is signed by the Administration of Justice clerk Miguel Ángel Bragado Lorenzo in Cádiz, on June 23, 2026, and is now published in the provincial gazette because it was not possible to summon the interested parties at the address listed in the file.

The occupants and the deadlines set by the decree

The decree identifies three people as owners or occupants of the property:

  • Rafael Al Lal Ferreira
  • Sandra Rodríguez Fernández
  • Lorena Al Lal Ferreira

The operative part establishes the following actions and deadlines:

  • The corresponding file is formed to process the entry request.
  • Before resolving, the request and documentation are forwarded to the Public Prosecutor’s Office, which must report within ten days.
  • The resolution is notified to the occupants so that they may present allegations within ten days.
  • An appeal for reversal (recurso de reposición) may be filed against the decree before the judicial office within five business days, with a deposit of 25 euros, except for exempt cases.

The court bases the initiation of the proceedings on Article 8.6 of Law 29/1998, of July 13, regulating the Administrative Litigation Jurisdiction, which requires forwarding the matter to the Public Prosecutor’s Office as the issue affects fundamental rights, and on Article 107.2 of the same regulation for the publication by edict. The notification to the occupants is agreed upon in accordance with Article 270 of the Organic Law of the Judiciary and Article 150 of the Civil Procedure Law.

The edict warns that the dissemination of the text to non-interested parties may only be done after the dissociation of personal data, in respect of the right to privacy, and specifies that the publication was requested by the jurisdictional body itself.

It is not an isolated case in the Justice Administration section of the bulletin: the BOP of Cádiz no. 198, of October 14, 2026, published another entry authorization decree, in this case from the Administrative Litigation Court no. 3 at the request of the Institute of Housing, Infrastructure and Equipment of the Defense (INVIED), for the forced execution of an eviction order for military housing in Cádiz.

The judicial authorization for entry is the step that allows the administration to execute an eviction when the occupant does not provide voluntary access to the property. In this case, it affects a dwelling managed by the public housing agency of the Junta de Andalucía, therefore the decree directly impacts the public residential stock of the capital and the situation of three people listed as occupants, who still have a period to file allegations before a decision is made regarding the entry.
