Jerez de los Caballeros initially approves the home help ordinance

The Plenary of the City Council of Jerez de los Caballeros, in an ordinary session held on 3 August 2026, initially approved the Ordinance regulating the operation of the home help service and the accompaniment service. The agreement has been published in the Official Bulletin of the Province of Badajoz, number 153, of 12 August 2026, through Announcement 3173/2026, which includes the full text of the regulation and its three annexes.

The ordinance, 24 pages long, replaces the previous municipal regulation of the home help service (SAD), which it expressly repeals, and is based on Law 14/2015, of 9 April, on Social Services of Extremadura, on Law 39/2006, of 14 December, on the Promotion of Personal Autonomy and Care for Persons in Situations of Dependency, and on Decree 12/1997, of 21 January, of the Department of Social Welfare, which develops the basic provisions of municipally owned social services.

Two services for staying in the usual environment

The SAD provides at home domestic, personal, family support and community relations care to those who cannot carry out their usual activities due to situations of special need. The accompaniment service aims to prevent loneliness and isolation, foster relationships with the environment, and provide respite to primary caregivers. Both are conceived as preventive provisions with resources limited by the budget allocation of each financial year, of a temporary nature and not as a subjective right.

The following may request them:

• Persons over 65 years of age with difficulties in their personal autonomy.
• Persons with a disability recognised by the competent body that significantly affects their autonomy.
• Persons in other risk situations detected by the Basic Social Care Social Services (SSASB).

The SAD is provided from Monday to Friday, with a general maximum of two hours per day (fifty-two per month in exceptional cases) and a minimum of one and a half hours per week. The accompaniment service is preferably provided in the afternoon, also on working days.

Need assessment scale: points by situation and age

The award is decided by applying the scale in Annex II of the ordinance, after the home visit by social work staff, with the following weighting:

• Economic situation: maximum 20 points.
• Personal autonomy: maximum 35 points.
• Housing situation: maximum 20 points.
• Socio-family situation: maximum 30 points.
• Age: maximum 10 points.

Anyone who obtains zero points in the economic section has no right to the service. Persons who cannot be attended are placed on a waiting list, with priority for those who lack real estate assets and with the application valid until 31 December of the year following the year in which it was submitted.

Public price based on per capita income

The price per hour of provision is determined based on the monthly per capita income of the household, referenced to the IPREM (Public Indicator of Multiple Effects Income):

• Between 100% and 110% of the IPREM: 10% of the cost/hour.
• Between 111% and 120%: 15%.
• Between 121% and 130%: 20%.
• Between 131% and 140%: 30%.
• Between 141% and 150%: 40%.
• Between 151% and 160%: 50%.

The cost/hour shall be that set annually by the Junta de Extremadura. For the calculation, the household’s annual income, with prorated payments, is divided by twelve and by the number of members, or by 1.5 when the person lives alone. Payment is collected bimonthly by direct debit, and non-payment for two months results in automatic cancellation, with a 20% surcharge in enforcement proceedings.

Thirty days for objections

The file is subject to public inspection for a period of thirty days from the day following its publication in the provincial bulletin and on the Corporation’s notice board, during which it may be examined at the municipal offices and at the City Council’s electronic office (http://jerezdeloscaballeros.sedelectronica.es). If no objections are raised, the resolution shall be deemed finally approved without the need for an express decision; the ordinance shall enter into force once finally approved by the Plenary and published, after the review of the files currently in force provided for in its transitional provision. The notice is signed by the mayor, Raúl Gordillo Barroso.

The new regulation provides legal certainty to a basic municipal social service that affects those over 65 years of age and dependent persons in Jerez de los Caballeros and its outlying villages: it regulates access by means of an objective scale, makes the cost predictable according to income and reinforces control over public spending, while maintaining the service in the usual environment as an alternative to institutionalization.
