The Jarindo wind farm project has been cancelled following the denial of air safety clearance
Por FactBox Admin

Green Capital Power, S.L. has withdrawn its application for the permit of the Jarindo wind farm, and the project has been halted. The director of Decarbonization, Guillermo Allende Aranguiz, accepted the withdrawal through a resolution dated October 6 and ordered the filing of the case. The resolution was published in issue number 202 of the Official Gazette of the Basque Country on October 22, 2026, with official reference 2026/4432.
The wind farm was planned across four municipalities: Aramaio and Legutio (Araba) and Eskoriatza and Leintz-Gatzaga (Gipuzkoa). The case number is 01 GE Y 202400010. On September 12, 2024, the directorate of Strategic Projects notified the company of the resolution of the competitive procedure, in which the preliminary project of Green Capital Power, S.L. was selected. That resolution paved the way for the subsequent processing of the administrative permit, which is what has now been stopped.
Negative response from the air safety agency
The reason for the withdrawal is a negative communication sent by the State Air Safety Agency (AESA). The company submitted the withdrawal request on July 23, 2026, after receiving the agency’s negative response. The resolution does not specify the content of the denial, but it makes clear that as a result, the company decided to abandon the permit application.
The air safety report is fundamental in such infrastructures: it must be verified that wind turbines respect aircraft safety distances and the operation of radio services, and when these conditions are not met, the administration does not grant the permit.
Filing of the case
The resolution contains two main decisions:
- To accept the withdrawal request submitted by Green Capital Power, S.L. regarding the permit for the Jarindo wind farm project.
- To order the filing of the corresponding case.
The filing is not a prohibition of the project, but rather the consequence of the company itself abandoning the request: the administration did not deny the permit, but rather recognized that the company withdrew. This means that the project is not being processed, and there is no permit in force.
Regulatory framework and competence
The Decarbonization directorate is the competent body to process and resolve the case, as established by Decree 410/2024, of December 3, which establishes the organic and functional structure of the Department of Industry, Energy Transition and Sustainability.
The withdrawal is based on Article 94 of Law 39/2015, of October 1: the interested party may withdraw their request, and the administration will accept it outright and consider the procedure finished, unless third parties request its continuation within ten days.
Appeal and signature
This resolution does not exhaust the administrative route. On the contrary, an appeal may be filed before the Undersecretary for Energy Transition, within a period of one month, starting from the day following the notification of the resolution, in accordance with Article 121 and following of Law 39/2015. The resolution was signed in Vitoria-Gasteiz, on October 6, 2026.
The suspension of the project affects the planned installation in four municipalities and the schedule for the expansion of renewable energies. The archiving is not definitive: the company may submit a new request in the future, but currently Jarindo is not being processed and the administration has not granted any permits. The case demonstrates that air safety conditions have a decisive weight in the feasibility of wind farms.
