Jaén makes the productivity supplement regulation final

The Jaén City Council has finalized the regulatory framework for the productivity supplement for its staff and autonomous bodies, as no claims were filed during the public exhibition period. The decision, adopted by the municipal Plenary and announced by the fifth deputy mayor delegated to the Human Resources Area, Carlos Alberca Martínez, is published in the Official Gazette of the Province of Jaén, number 178, dated September 14, 2026, pages 13565 to 13573, under reference 2026/4266.
The regulation replaces and updates the framework that came into force the day after its publication in BOP number 45, dated July 30, 2020, and which had already been modified in its article 4 in BOP number 149, dated August 5, 2021. After several years in effect, the Council has detected new situations that should entitle the receipt of this supplement; therefore, the reform seeks to provide legal protection for any amount to be received and to avoid interpretations and arbitrariness.
Two remuneration programs
The productivity supplement rewards the degree of interest, initiative, or effort of the employee in the performance of their work, and does not constitute either an objective right or consolidated remuneration. The allocation is structured into two programs:
- Quality Improvement Program, with previously established objectives, which weights training (15%), objectives (35%), initiative and implementation of process systems (35%), and involvement in commissions, working groups, procurement boards, and collective projects (15%).
- Extraordinary Services Program, which rewards activities of great complexity, commitment, or relevance, the assumption of tasks from employees absent for more than one month, and remuneration differences due to provisional leadership or mobility.
Amounts and limits
The global annual amount is set each year in the General Budget of the City Council and in that of each dependent entity, without exceeding the limit of article 7 of Royal Decree 861/1986, of April 25. The allocation per recipient may not exceed 300.00 euros per month, except in cases of provisional leadership or mobility.
The regulation also provides for specific remuneration for officials of the Fire Prevention, Extinction, and Rescue Service who provide service outside the municipal boundaries of Jaén by virtue of agreements with the Provincial Council:
- €161.00 per month for the firefighter-driver category.
- €175.00 per month for the corporal and sergeant categories.
Evaluation, monitoring, and exclusions
The evaluation is carried out by the hierarchical superior using Annex I, and the final assessment corresponds to the Local Government Board, which determines the assigned amount. A Joint Monitoring Commission is created, chaired by the Mayor’s Office or the Human Resources Department, with union and Corporation representation, to resolve disputes in the application of the regulation.
Those who do not propose objectives, fail to meet pre-established ones, have been subject to disciplinary sanctions, have a negative hourly balance or repeated incidents, or remain in a state of temporary disability are excluded from the supplement. The amounts received shall be public knowledge among employees and union representatives.
Retroactive recognitions
The sole transitional provision provides for an individualized study of possible retroactive recognitions corresponding to the second semester of 2024, between July 1 and December 31. The study will be conducted by the technical services of the Human Resources Area and will be submitted to the Monitoring Commission, without implying the automatic or generalized recognition of any right.
The regulation will enter into force the day following its publication in the BOP, after having been negotiated in the General Negotiation Table and approved by the Plenary, with its application conditioned upon budget availability. An administrative appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Andalusia based in Granada, within a period of two months.
The reform affects thousands of municipal employees, career and interim civil servants, permanent or indefinite labor personnel, and personnel with national authorization in active service, and provides greater legal certainty and transparency to a variable supplement that rewards performance and commitment to public service.
