Interior will instruct the disciplinary proceedings of the Vielha local police

The Department of Interior and Public Security of the Generalitat de Catalunya will conduct the disciplinary proceedings and reserved inquiries of the Local Police of Vielha e Mijaran. The management assignment was formalized through a collaboration agreement signed electronically on September 14, 2026, and published in the Official Gazette of the Province of Lleida no. 179, of September 18, 2026 (CVE BOP-2026_0_179_7708, pp. 1-3).
The City Council of Vielha e Mijaran approved the assignment by agreement of the Local Governing Board on April 8, 2026, and on March 25, 2026, the same body had authorized the mayor to sign the agreement. The publication is made for the purposes of article 8.1.b) of Law 19/2013, of December 9, on transparency, access to public information and good governance, in accordance with article 11.3.b) of Law 40/2015, of October 1, on the legal regime of the public sector.
The agreement responds to article 17.5 of Decree 179/2015, of August 4, which approves the Regulation of the disciplinary regime procedure applicable to the local police forces of Catalonia, which empowers the mayor to request the collaboration of the competent department in matters of organization and coordination of local police. The City Council has requested the appointment of an instructor to process a file derived from the conduct and actions of a member of the force that could be subject to disciplinary reprimand.
Who signs and what is assigned
- Tomás Carrión i Bernal, Secretary General of the Department of Interior and Public Security, by virtue of Resolution INT/81/2011, of January 18, on the delegation of powers of the Minister of Interior.
- Juan Antonio Serrano Iglesias, Mayor of Vielha e Mijaran, authorized by the agreement of the Local Governing Board of March 25, 2026.
The objective is to establish the framework for collaboration between the Department, through the Sub-directorate General for Support of the Security System in the Local Sphere of the General Directorate for Coordination of Local Police, and the City Council for the processing of the corresponding reserved information or disciplinary file. The Department commits to proposing a civil servant of an equal or higher body or category for the instruction and, if appropriate, a secretary.
Obligations of the City Council and validity
The City Council must guarantee the exercise of the instructor’s functions and, in any case:
- Provide the necessary material and technical means for the correct instruction.
- Pay the expenses of the instructor or secretary derived from the processing (subsistence allowance and mileage).
- Designate a secretary from among the municipal civil service staff when the complexity of the procedure requires it.
- Guarantee the confidentiality and rights of the person under investigation and the witnesses.
The agreement is in effect from the date of signature until the completion of the actions, for a maximum of four years, extendable for up to four additional years by unanimous agreement of the parties. Causes for termination include the fulfillment of the objective, the end of the term without extension, mutual agreement, failure to comply with obligations, and the general causes established by current legislation.
Monitoring commission and economic regime
A monitoring, surveillance, and control commission is created, composed of:
- The Secretary of the City Council, or the person to whom they delegate.
- A Human Resources technician from the City Council.
- Two technicians designated by the Sub-Directorate General for Support to the Security System in the Local Sphere.
The commission will meet at the request of one of the parties, and one of the Department’s technicians will draw up the minutes of the meetings. The signature does not entail any expense or financial commitment for any of the parties, except for those derived from municipal obligations. The agreement is administrative in nature, and disputes shall be submitted to the contentious-administrative jurisdiction.
The publication of the assignment provides transparency to a procedure that is usually reserved: the external instruction of disciplinary proceedings for local police officers by the Generalitat, a mechanism designed to guarantee impartiality when the council cannot undertake the instruction with its own means.
